مشکلات نظارت قضایی بر نهادهای انقلابی با تاکید بر سازمان تبلیغات اسلامی

از جمله معیارهای اصلی نظام مردم‌سالار، تضمین حقوق و آزادی‌های افراد جامعه است. این مهم از طریق اعمال حاکمیت قانون نسبت به سازمان‌ها و مقاماتی که عهده‌دار امر عمومی‌اند، انجام می‌گیرد. نظارت قضایی به‌عنوان یکی از ابزارهای حاکمیت قانون، به تحدید قدرت حکومت به‌منظور احقاق حقوق شهروندان می‌پردازد. منظور از نظارت قضایی، رسیدگی به شکایات و تظلمات مردم از دستگاه‌های اجرایی است. سازمان تبلیغات اسلامی نیز به‌عنوان یکی از نهادهای انقلابی، به دلیل برخورداری از اقتدارات ناشی از قدرت عمومی، از این امر نمی‌تواند مستثنا باشد. نظارت قضایی می‌تواند یکی از ابزارهای موثر جهت پاسخ‌گوکردن و تضمین حقوق افراد جامعه در برخورد با این سازمان باشد. در نوشتار حاضر، با استفاده از روش تحقیق توصیفی‌تحلیلی، این سوال طرح شده است: مشکلات نظارت قضایی بر نهادهای انقلابی با تاکید بر سازمان تبلیغات اسلامی چیست؟ در پاسخ به این سوال، نظارت قضایی بر سازمان تبلیغات اسلامی از دو طریق دیوان عدالت اداری و دادگاه‌های عمومی به بحث گذاشته شده و چنین نتیجه‌گیری شده که نظارت قضایی بر این سازمان با محدودیت‌هایی مواجه است. از جملۀ آن‌ها می‌توان به دوگانگی شخصیت حقوقی این سازمان اشاره کرد که خود نیاز به تبیین دارد؛ چراکه، باعث بروز مشکلاتی در نظام حقوق اداری و نظارت قضایی بر سازمان مذکور شده است.

Difficulties of Supervisin on the Revolotionary Institutions with Emphasis on Islamic Development Organization

One of the main criteria of the democratic system is guaranteeing the rights and freedoms of the community. This subject will be done through the rule of law towards the organizations and authorities responsible for public affair. Judicial rewiew as one of the tools of the rule of law, in order to enforce citizens’ rights, reduces government power. The purpose of judicial supervision is the handling of complaints and petition by people from executive agencies. Islamic development Organization as one of the Revolotionary institutions, this can not be excluded for the power of public authority.In the present paper, using descriptiveanalytic research method, this question has been raise: What are the problems of judicial supervision over revolutionary institutions with emphasis on Islamic Development Organization? In response to this question, the Judicial supervision on the Islamic development organization The Administrative court and the public Courts have been discussed in two ways and this is the conclusion: The judicial review on this organization is subject to limitations. The dichotomy of the legal personality of this organization needs to be explained; because it has causesed some problems in the administrative law system and judicial review of the organization.
