ترتیب اجرای کیفرهای متعدد در فرض اجتماع در حقوق جزای ایران

این مقاله ضمن ترسیم گونه‌های مختلف تزاحم میان اجرای مجازات‌ها، شماری از معیارها و شاخص‌های مربوط به حل تزاحم در فرض اجتماع کیفرها را به بحث می‌گذارد. مقاله تاکید می‌کند که یکی از معیارهای قاطع حل تزاحم کیفرها، تقدم حق‌الناس بر حق‌الله است. مقاله ضمن توصیف ماهیت و تعریف حق‌الله، حق‌الناس و مصادیق آن‌ها در انواع کیفرها، به ادلۀ تقدیم حق‌الناس بر حق‌الله پرداخته است. همچنین به نکاتی کاربردی در جهت اجرای مجازات‌ها در فرض اجتماع اشاره شده و صورت‌های گوناگون اجتماع مجازات‌ها به‌تفکیک بررسی شده است. یکی از این صورت‌ها اجتماع مجازات‌های حدی با قصاص است که در صورت تزاحم، به تقدم قصاص که ماهیتی حق‌الناسی دارد، حکم می‌شود. مقاله سرانجام به بررسی و نقد قوانین و مقررات جزایی جمهوری اسلامی ایران و شواهدی از رویۀ قضایی موجود در ارتباط با ترتیب اجرای کیفرها پرداخته و برای بهبود وضعیت کنونی پیشنهادهایی ارائه نموده است.

The Order of Execution of Conflicting Punishments in Iranian Criminal Law

This article has drawn various kinds of conflict in implementation of punishments in jurisprudential (fiqhi) approach and from Iranian penal code’s point of view. Since the crimes and punishments have not been classified based on the seriousness and weakness of crimes it is complicated to find the ways of conflict resolution in case of conflict in implementation of punishment. The article emphasizes that one decisive criterion for conflict resolution in implementation of punishments in Islamic jurisprudence is the priority of those relating to God’s rights over those containing people’s rights. The article has shed light on the nature of God’s rights (Hagh Allah) punishments and people rights (Hagh alNas) punishments and the examples of each category. The article explains evidences in favor of priority of people rights over God’s rights and criticizes the position taken by Iranian penal code over the issue. At the end, the article suggests proposals for improvement of the related articles and regulations in Iranian criminal law
