عدالت کریمانه؛ راهبردی برای تضمین حقوق شهروندی و حفظ امنیت اجتماعی

زمینه و هدف: یکی از مسائل مهم در نظام‌های حقوقی مختلف دنیا، ایجاد تعادل و توازن میان سطح رعایت حقوق شهروندی و تضمین امنیت اجتماعی است؛ چراکه تحقق نظام حقوقی مطلوب، نیازمند کاهش تزاحمات یاد‌شده و رفع مشکلات اجرایی به‌ویژه در ماموریت‌های پلیسی و امنیتی - انتظامی است. در این راستا، بدواً باید روابط و نسبت‌های میان دو مفهوم بنیادینِ یاد‌شده، به‌لحاظ کاربردی و نظری، بررسی و تبیین شوند تا از این رهگذر بتوان، جلوه‌های تزاحم این دو را شناخت و برای حل و رفع تزاحم یاد‌شده، راهبرد ارائه کرد.روش پژوهش: نوشتار حاضر از منظر هدف، کاربردی و با روشِ توصیفی – اسنادی، به سامان رسیده است. داده‌ها و اطلاعات مورد نیاز، به روش کتابخانه‌ای گردآوری شده و با روش توصیفی – تحلیلی، بحث شده است.یافته‌ها: بر اساس یافته‌های پژوهش، حاکمیت، نظام حقوقی و به‌ویژه نهادهای انتظامی و امنیتی نظیر پلیس و ضابطان قضایی می‌توانند با نهادینه‌سازی و جاری ساختنِ دو نهاد «عدالت» و «کرامت» در سیاست‌ها و رسالت‌ِ خود زمینه را برای تضمین حقوق شهروندی و حفظ امنیت اجتماعی ایجاد کنند.نتیجه‌گیری: از تحلیل یافته‌های پژوهش مبتنی بر آموزه‌های فقه مبین اسلام، به این نتیجه دست یافتیم که «عدالت‌محوری» توام با «کرامت‌مداری» می‌تواند راهبردی مهم تحت عنوان «عدالت کریمانه» یا «کرامت عادلانه» باشد که برای تضمین حقوق شهروندی و حفظ امنیت اجتماعی، باید در سه سطح تقنین، قضا و اجرا؛ به‌ویژه توسط نهادهای امنیتی، ضابطان قضایی و دست‌اندرکاران امور اجرایی نظم و امنیت کشور پیاده‌سازی شود.

objective and background: one of the important issues in various legal systems in the world is to create a balance between the level of respect for civil rights and the guarantee of social security, as the realization of a desirable legal system requires the reduction of these conflicts and the resolution of executive problems, especially in police and security missions. in this regard, first of all, it is necessary to examine and clarify the relationships and proportions between the two fundamental concepts mentioned, theoretically and practically. in this way, it is possible to recognize the interference of these two and to present a strategy to resolve and eliminate this interference.method: the present paper is applied in terms of its purpose and has been organized using a descriptive-documentary method. the required data and information were collected through library methods and discussed using a descriptive-analytical method. findings: according to the research findings; the government, the legal system, and especially security and law enforcement institutions such as the police and judicial officers may establish the ground for guaranteeing civil rights and maintaining social security by institutionalizing and implementing the two bodies of justice and dignity in their policies and missions.conclusion: the analysis of the research findings based on the teachings of islamic jurisprudence, it could be concluded that “justice orientation” along with “dignity orientation” could be an important strategy under the title of “criminal justice” or “just dignity” that should be implemented in three levels of legislation, judiciary, and execution; especially by security institutions, judicial officers and those involved in the country’s executive affairs of order and security.
