الگوی حقوقی «پلیس مقتدر، امین مردم»

پلیس در تمامی نظام های حقوقی وظیفه برقراری نظم عمومی محور را بر عهده دارد و برقراری نظم عمومی نیازمند اعمال اختیارات ویژه و بهره گیری از وجه آمره بودن قانون است. با این وجود نظم عمومی در مفهوم جدید و البته مبتنی بر آموزه های اسلامی امری یک جانبه نیست و لازم است مقید به الزامات مشخص و در خلال مشارکت اجتماعی و تعهد به سرنوشت مشترک مبتنی بر اصل نهم قانون اساسی و با همکاری عامه مردم فراهم شود. این همکاری نیز مبتنی بر احساس کارا بودن مشارکت و اعتماد به پلیس به عنوان امانتدار حوزه امنیت عمومی حاصل می شود. در این مقاله در پاسخ به این سوال که «مبانی و سازوکارهای حقوقی تحقق پلیس مقتدر و امین مردم چیست؟» به طراحی الگوی حقوقی «پلیس مقتدر، امین مردم» می پردازیم به نحوی که پلیس در انجام وظایف قانونی خود در استقرار نظم و امنیت عمومی از کارآمدی مطلوب برخوردار شده و البته در نظر داریم که این کارآمدی نیازمند اعطای تضمیناتی عینی از جانب پلیس به مردم است مبنی بر اینکه پلیس، نظم را در چارچوب قانون و منافع عمومی تعهد و تامین می کند، تسامح  پذیر و سلیقه گرا نیست، تحت نظارت و راهنمایی های مراجع قضائی عمل می کند، به حقوق و آزادی های مشروع مردم نیز تجاوز نمی نماید. به این ترتیب پلیس درصدد استقرار امنیت شهروندمدار و اجتماعی شده است که با شهروندان بر اساس اخلاق حرفه ای و با برهم زنندگان نظم عمومی با قاطعیت مورد حمایت قانون برخورد موثر می نماید.

Legal pattern “Strong police, trustworthy people”

In all legal systems, the police have the task of establishing a publiccentered order, and the establishment of public order requires the exercise of special powers and the enjoyment of the law. However, public order in the new sense, and, of course, based on Islamic teachings, is not unilateral, and must be bound by specific requirements and through social participation and a commitment to a common destiny based on the Ninth Principle of the Constitution and in cooperation with the general public. The partnership also builds on the sense of participation and trust in the police as trustees of the public security domain. In this article, in response to the question, “What are the legal bases and mechanisms for the realization of a strong and trustworthy police?” We are designing the legal pattern of “a strong police, trustworthy people” so that the police can perform their legal duties in establishing order and order. Public security is wellfunctioning and, of course, we consider that it requires that the police provide objective guarantees to the public that the police are committed to the law and in the public interest, tolerant and tasteful. It is nondiscriminatory, operates under the supervision and guidance of judicial authorities, and does not violate the legitimate rights and freedoms of the people. As such, the police have sought to establish citizen centered and social security that treats citizens on the basis of professional ethics and disrupts public order in a lawabiding manner.
