مفهوم و شرایط تحقق اثر مشترک ادبی و هنری در نظام حقوقی ایران و آمریکا

آثار ادبی و هنری مشترک که امروزه در جوامع علمی، فرهنگی و هنری به‌ویژه در مجامع دانشگاهی رشد فزاینده داشته است، اهمیت دارد. مسئله مفهوم و شرایط تحقق اثر مشترک در نظام‌های حقوقی مختلف وجوه اشتراک و افتراق دارد. این نوشتار با مطالعه تطبیقی مسئله مزبور در نظام‌های حقوقی ایران و ایالات متحده آمریکا به این نتیجه دست­ یافته است که اثر مشترک در حقوق ایران صرفاً ناظر به آثاری است که سهم پدیدآورندگان مختلف در اثر ­تفکیک‌نشدنی است. حال آنکه در حقوق آمریکا، در موردی که سهم پدیدآورندگان انفکاک‌شدنی بوده، ولی به یکدیگر وابسته‌اند، نیز تحقق اثر مشترک ممکن است. همین امر موجب تفاوت بنیادین در مصادیق اثر مشترک در دو نظام حقوقی است. در هر حال، در هر دو نظام حقوقی قصد مشارکت در زمان خلق اثر و تحقق عملی مشارکت از شرایط تحقق اثر مشترک است. البته در حقوق آمریکا قصد «شناخته‌شدن به‌عنوان پدیدآورنده مشترک» نیز علاوه بر قصد مشارکت، لازم است.

The Concept and Realization of the Joint Works in Iran and America Law

Literary and artistic joint works are prepared by two or more authors. It's Importance, have increasingly grown today, particularly in academic areas. One of the issues related to these works is the problem of identifying the concept and realization of the joint works in the different legal systems which has similarities and differences. This research is a comparative study in mentioned issue in Iran and America law. According to researches which have been done in the context of joint work, in Iranian law, the joint work simply refers to works that contains inseparable parts of the various authors. But, in United States legal system even authors share interdependent parts, joint work can become exist. However, in both legal system, authors must intent to participate in making the work while the work is making. In American law, the intention of being a coauthor is also needed.
