اختلاف در صلاحیت بین دادگاه‌‌ها و مراجع غیر قضایی

به موجب ماده‌ 28 ق.آ.د.م.: «... در مواردی که دادگاه‌‌ها اعم از عمومی، نظامی، و انقلاب به صلاحیت مراجع غیر قضایی از خود نفی صلاحیت کنند و یا خود را صالح بدانند، پرونده برای حل اختلاف به دیوان عالی کشور ارسال خواهد شد ...». مطابق رای وحدت رویه‌ شماره‌ 660 مورخ 19/01/1382 هیئت عمومی دیوان عالی کشور نیز در مواردی که دادگاه‌‌ها به صلاحیت مراجع غیر قضایی از خود نفی صلاحیت کنند یا خود را صالح بدانند، نیازی به حدوث اختلاف نیست و پرونده مستقیم برای تشخیص صلاحیت به دیوان عالی کشور ارسال می‌شود. حکم و عبارت ماده‌ 28 ق.آ.د.م. در بخش مربوط به تعارض در صلاحیت بین دادگاه‌‌ها و مراجع غیر قضایی و رای وحدت رویه‌ مربوط به آن از جهات متعدد قابل تامل و قابل انتقاد است. بررسی موضوع نشان می‌دهد حکم ماده‌ یادشده و رای وحدت رویه‌ مربوط به آن در قسمتی اشتباه و در قسمتی منطقی نیست و اصلاح قانون در این زمینه ضروری است.
