تفسیر قوانین مقتبس؛ کاربست‌ها و رویکردها

اقتباس قانون از کشورهای دیگر پدیده‌ای است که نقش مهمی در شکل‌گیری و تکامل نظام‌های حقوقی مدرن ایفا کرده است. این فرایند که در مباحث حقوقی به عنوان «پیوند حقوقی» شناخته می‌شود به‌ویژه در قرن اخیر با مدرنیزاسیون و جهانی شدن شتاب بیشتری گرفت. در این میان، ایران نیز از این قاعده مستثنی نبوده و اقتباس قانون از سایر کشورها به عنوان راهکاری برای نوسازی نظام حقوقی مورد توجه قرار گرفته است. پژوهش حاضر به بررسی چالش‌های تفسیر قوانین مقتبس در نظام حقوقی ایران می‌پردازد و اهمیت کارکردها و رویکردها در تفسیر قانون مقتبس را مورد کنکاش قرار می‌دهد. بحث از تفسیر قوانین مقتبس، به فهم دقیق‌تر، اجرای موثرتر این قوانین، و هماهنگی بیشتر نظام حقوقی ایران با استانداردهای بین‌المللی می‌انجامد. با وجود کثرت قوانین مقتبس و چالش‌های موجود دو رویکرد عمده قابل تشخیص است؛ تفسیر سنتی که بر اساس اصول و مبانی حقوقی داخلی صورت می‌گیرد و تفسیر استثناگرایی حقوقی که بر توجه به منشا قانون مقتبس تاکید دارد. این پژوهش با بهره‌گیری از روش توصیفی‌‌ تحلیلی ضمن بیان ویژگی‌های قوانین مقتبس و برخی مصادیق اصول حاکم بر قانون ماخذ به بررسی چالش‌های تفسیری و رویکردهای مختلف در حل این چالش‌ها می‌پردازد.

interpretation of adapted rules: applications and approaches

adaptation of law from other countries is a phenomenon that has played an important role in the formation and evolution of modern legal systems. this process accelerated especially in the last century due to modernization and globalization. iran is not an exception to this rule, and the adaptation of laws from other countries has been considered as a way to modernize the legal system. the present study examines the challenges of interpreting the adapted laws in iran’s legal system and explores the importance of the factors and approaches in the interpretation of the adapted laws. the discussion of the interpretation of the adapted laws leads to a more accurate understanding, more effective implementation of these laws and greater coordination of the iranian legal system with international standards. despite the multitude of adapted laws and existing challenges, two main approaches can be distinguished: the traditional interpretation based on domestic legal principles and foundations, and the interpretation of legal exceptionalism which emphasizes attention to the origin of the adapted law. this research, using the descriptive-analytical method, while expressing the characteristics of the adapted laws and some examples of the principles governing the source law, examines the interpretive challenges and different approaches in addressing these challenges.
