رابطه خصوصی به هر نوع رابطه کتبی یا شفاهی اطلاق می‌شود که بدون حضور و اطلاع طرف دیگر دعوا بین داور و یکی از طرفین پرونده برقرار می‌شود. در این فرایند یکی از طرفین دعوا، بدون اینکه طرف مقابل او اطلاعی از این رابطه داشته باشد، به صورت پنهانی در خصوص موضوع اختلاف، ادله، اسناد، مدارک، و جزئیات پرونده با داور مذاکره می‌کند. در مواردی همان طرف به جای گفت‌وگوی مستقیم در خصوص دعوا سعی می‌کند با توسل به شکل خاصی از روابط داور را تحت تاثیر قرار دهد تا از این طریق بتواند تمایل و گرایش شخصی‌ درونی داور را به سمت خود جلب کند. رابطه پنهانی در داوری خلاف اصل رسیدگی برابر و عادلانه است و به صورت مشخص استقلال و بی‌طرفی داور را از بین می‌برد. داوری که با یکی از طرفین وارد رابطه پنهانی شده باشد قابل اعتماد نیست و طبعاً اعتبار رایی که از این فرایند صادر شده باشد نیز محل تردید قرار می‌گیرد. با این حال در خصوص میزان و سطح رابطه و محتوای ارتباط خصوصی اختلافانی وجود دارد. مقاله پیش رو به دنبال بررسی دقیق ارکان ارتباط خصوصی، مفهوم، و در نهایت نتایج حاصل از آن در داوری تجاری بین‌المللی است.

Considering the Ex parte communication and its effect on validation of international trade arbitral verdict

Ex parte communication is any oral or written or any kind of communication with arbitrators in absence of the opposite party, which occurs unilaterally. In this process one of the dispute party engages hidden communication with arbitrator (Exparte communication) and negotiates with arbitrator about dispute, documents, evidences, details and any other related issue to the current case. In some cases instead of direct communication, the party attempts to use different means in order to impress arbitrator and therefore attracts his intention and bias to himself. Exparte communication is clearly against arbitrator’s independence and impartiality. the arbitrator which engages ex parte communication in clearly unreliable and untrustworthy and therefore the arbitration process and its verdict will become doubtable. But there are some differences in lawyers opinions about the exact meaning of ex parte communication and its content. This article is trying to consider ex parte communication, the exact meaning of that and its content, its organs and at the end considering its effect on arbitration and the arbitral verdict.
