چکیده
|
زندگی‌دوم دنیای مجازی مهمی است که با ویژگیهای منحصربه‌فرد خود، مانند امکان خلق آثار متنوع ادبی و هنری، مسائل حقوقی مختلفی را ایجاد کرده است. با توجه به قرارداد اولیه مدیران تارنما با کاربران و شرایط خدمترسانی دنیای یادشده، این موافقت‌نامه و مجوزهای متنباز ممکن است مشابه به نظر برسند. در عین حال، برخی تفاوتها موجب تمایز آن‌ها از هم میشود. با عنایت به اینکه خلق آثار در زندگی‌دوم با استفاده از امکانات تارنما انجام میشود، موضوع تعیین مالک این آثار اهمیت زیادی دارد. همچنین، نحوه حمایت از آثار خلق‌شده توسط کاربران و تطبیق شرایط حمایت مقرر در نظام حقوق مالکیت ادبی و هنری بر این آثار نیازمند بررسی است. نتایج این پژوهش نشان میدهد فقط کاربر را باید پدیدآورنده و دارنده آثار ادبی و هنری اصیل خلق‌شده در زندگی‌دوم بدانیم. یکی از ایرادهای تارنمای یادشده وابسته بودن بقای آثار ادبی و هنری کاربران زندگی‌دوم به اراده مدیران تارنماست که چون طرفین درباره آن توافق میکنند مانع اقامه دعوا علیه مدیران میشود.

Literary and Artistic Rights in Second life Virtual World

Abstract
|
Second life is an important virtual world that due to its unique features like the ability to create diverse literary and artistic works has created a variety of legal issues. Given the existing terms of service of this website with its residents, its agreement and open source licenses may seem to be similar. However, the differences cause distinguishing them. Since the creation of works in second life is done using its facilities, it is very important to determine the owner of such works. In addition, the way these works are protected by users and the application of conditions of copyright protection to them should be examined. The results of this article show that only the user should be considered as the author and owner of original literary and artistic works created in second life. As one of the drawbacks of this website, one may say that the survival of literary and artistic works of secondlife users is dependent on the will of owners on which parties have agreed on. Hence, it prevents the former from taking action against latter.
