وقف در آیینه آیات و روایات با بررسی شمول آن در مالکیت فکری

وقف؛ با تکیه بر بار معنایی آن در عیون، توانسته بسیاری از نیازهای بشری را برآورده سازد و حال این پرسش ایجاد می‌گردد که آیا وقف در حقوق معنوی و غیر عین نیز جاری است یا خیر؟ مشهور فقهای امامیه با محدود در نظر گرفتن دایره اموال در اموال مادی برای موقوفه شرایطی را ذکر کرده‌اند که این شرایط فقط بر اموال مادی قابل تطابق است و حال آنکه با گسترش دایره اموال و توسعه بازارهای اقتصادی؛ امروزه اموالی ‌بوجود آمده که مادی نیستند اما ‌ارزش مالی آنها کمتر از اموال مادی نیست. در این پژوهش با نگاهی دیگر به آیات و روایات و نقد و بررسی دلایل منکرین صحت وقف حقوق مالکیت فکری به عنوان مالی غیرمادی نظریه صحت وقف این اموال ثابت می‌شود.

endowment in the mirror of verses and hadiths by examining its inclusion in intellectual property

waqf (endowment) relying on its semantic load in property, has been able to meet many human needs, and now the question arises whether waqf is also valid in spiritual and non-material rights? the famous imāmiyyah jurists, by limiting the circle of property to material property, have mentioned conditions for the endowment that these conditions can only be applied to material property; but, with the expansion of the circle of property and the development of economic markets; today, there are properties that are not material, but their financial value is not less than material property. in this study, by looking at the verses and narratives and criticizing and examining the arguments of the deniers, the validity of the endowment of intellectual property rights as non-material financial, the theory of the validity of the endowment of these properties is proven.
