اکراه در عمل به شریعت از منظر قرآن و حدیث

اکراه در دین می تواند در سه موضوع دین آوری، دین داری و عمل به دین مورد بحث قرارگیرد. بسیاری از فقها با استناد به قرآن و احادیث اکراه مردم در عمل به احکام شرعی را جایز، و بعضی دیگر آن را غیر جایز می دانند. آثار زیادی که هر یک از این دو نظر در جامعه دارد ضرورت بررسی آن ها و دستیابی به یک نظر مستدل را، که هدف این مقاله است، بیشتر می کند. با استناد به ادله متعدد قرآنی و روایی می توان گفت: اکراه در عمل به شریعت مشروع نیست و ادله ای که ممکن است برای آن آورده شود قابل نقد است. هیچ کس مُجاز نیست مسلمانی را که نمی خواهد در بعضی موارد دین دارانه زندگی کند، به سبک زندگی دینی اکراه کند؛ حاکمیت دینی نیز نمی تواند با تکیه به دین، در جامعه شریعت اکراهی اقامه کند، مگر در مواردی، مثل مجازات های مصوّب که اغلبِ مردم بخواهند؛ که در این صورت در حکم اختیار جامعه و تخصصاً خارج از اکراه است.

Reluctance to Practice Shari'ah from the Perspective of the Quran and Hadith

Reluctance in religion can be discussed in three dimensions: the embrace of religion, religiosity and the practice of religion. Citing the Quran and hadiths, many Islamic jurists consider the reluctance of people to practice Shari #39;ah rulings permissible, and others consider it impermissible. The many effects that each of these two views has on society increase the need to examine them and reach a reasoned view, which is the purpose of this article. Citing various Quranic and narrational arguments, we can say that, according to the Shari #39;ah, reluctance in practicing religion is not legitimate, and the arguments given to support it can be criticized. No one is allowed to make a Muslim who does not want to live a religious life in some cases follow a religious lifestyle reluctantly. Nor can a religious governing body establish reluctance Shari rsquo;ah in society relying on religion, except in such cases as the approved punishments that most people desire, which, if so, is at the discretion of the society and especially out of reluctance.
