واکاوی آیه اشاعه فحشا و شمول آن نسبت به مصادیق نوپدید

اشاعه فحشا از موضوعاتی است که در آیه 19 سوره نساء بدان تصریح و از ارتکاب آن توسط مسلمانان نهی شده است. از جمله مباحث مهم پیرامون این آیه شناخت مفهوم این ترکیب و نیز حکم مقرر آن در قرآن و سایر ادله مرتبط می‌باشد. هچنین گستره شمول آیه نسبت به مصادیقی که در زمان نزول قرآن حادث نشده بود. در این مقاله سعی شده با بهره‌گیری از مواردی که سابقا از مصادیق مسلم این آیه به شمار می‌رفته وضعیت نمونه‌های جدید که حاصل تحول در ارتباطات و تعاملات انسانی به جهت پدیده ای نوظهور به نام فضای مجازی است، معلوم گردد. در این مقاله اشاعه فحشا به عملی اطلاق می‌شود که یا توسط مرتکب علنی شده و یا فرد دیگری آن را منتشر کرده است. از این رو عنصر اصلی در مفهوم و شناخت مصادیق نوظهور انتشار رفتار مذکور می‌باشد. از آنجا که این آیه در زمره آیات الاحکام بوده و فقیهان در تفسیر و تبیین آن اهتمام بیشتری نسبت مفسران نموده‌اند، توجه به تحقیقات آنان برای این نوشتار ضروری است.

An Exploration into the Quranic Verse Dealing with the Spread of Prostitution and its Inclusion of Emerging Examples

The spread of prostitution is one of the issues that verse 19 of Surah alNisa refers to, and it prohibits Muslims from committing it. Knowing the meaning of this issue, its ruling in the Quran and other sources and the scope of the verse's inclusion of the examples that did not occur at the time of the revelation of the Quran are among the important issues surrounding this verse. In this article, an attempt has been made to find out the status of the new examples of prostitution spread resulting from changes in human communication and interactions due to an emerging phenomenon called cyberspace using the cases that were previously considered as true examples of prostitution spread referred to in this verse. In this article, the spread of prostitution refers to an act that has either been made public by the perpetrator or by another person. Hence, the main element in the concept and recognition of emerging examples is the dissemination of this behavior. Since this verse is among the verses of the revealed prescripts and jurists have made more attempts than commentators to interpret and explain it, it is necessary to pay attention to their research in this article.
