چالش‌ها و راهکارهای حمایت کیفری از آفریده‌های فکری و هنری مُد (مطالعۀ تطبیقی نظام‌های حقوقی ایران، فرانسه و امریکا)

آفریده‌های فکری مد یا عنصر حیاتی صنعت مد از ارزش اقتصادی هنگفتی برخوردارند. چون رویکرد اصلی حمایت کیفری ارزش‌گرایی است، تلقی مد به‌عنوان ارزش موضوع حمایت کیفری در نظام کیفری ایران با چالش‌هایی در زمینۀ جرم‌انگاری و تعیین ضمانت اجرا روبه‌روست که این پرسش را طرح کرده: موازین جرم‌انگاری، مبانی، معیارها و مصادیق و تناسب ضمانت اجراها چقدر مورد توجه قانون‌گذار بوده ‌است؟ این پژوهش با روش توصیفی تحلیلی و با بررسی منابع کتابخانه‌ای، و در بخش تطبیقی با استفاده از منابع اینترنتی معتبر در قالب کتب، مقالات و متون قانونی حقوق مالکیت فکری مرتبط با حمایت از آثار فکری هنری مد به ارزیابی میزان رعایت موازین جرم‌انگاری، مبانی و معیارها و مصادیق در نظام‌های حقوقی ایران، فرانسه و امریکا پرداخته است. مطالعۀ حمایت‌های حقوق مالکیت فکری متناظر با آفریده‌های فکری یا طرح‌های مد در نظام حقوقی ایران، فرانسه و امریکا نشان می‌دهد اگرچه، برای مد، نظام حمایتی کلی زیر عنوان‌هایی که مستقیماً دربارۀ مد نیستند وجود دارد، امّا تصریح جایگاه این آثار در قانون، جرم‌انگاری رفتارهای ضرری اصلی، بازتولید و صور پخش مغفول مانده ‌است. نتیجۀ پژوهش نشان می‌دهد حمایت کیفری از آثار فکری هنری مد در نظام‌های فرانسه و بعضاً آمریکا بر موازین جرم‌انگاری مبتنی بوده و در تعیین ضمانت اجراها به ماهیت نوآورانه، هنری و اقتصادی آفریده‌های فکری مد توجه شده؛ اما، در ایران، نابسندگی رعایت موازین جرم‌انگاری رفتارهای نقض حق و عدم تناسب و نابسندگی ضمانت اجراهای موجود از چالش‌های عمدۀ حمایت کیفری به شمار می‌آیند.

Challenges and Strategies for Criminal Supports from intellectual and Artistic Creations of Fashion (Comparative Study of Legal Systems of Iran, France and the USA)

fashion Intellectual creation, the vital element of the fashion industry, is of great economic value. As the main approach of criminal support is value oriented, considering fashion to be a value in criminal support in the Iranian penal system is faced with challenges in some areas, such as criminalization and determining the sanction. This raises the following question: To what extent have the lawmakers focused on the standards of criminalization, basic principles, criteria, applicability, and the proportionality of sanction. Given the Iran and the French legal system as a relatively suitable criminal supporting system, as well as the United States, it seems that, although some support has been given to these intellectual creations under some headings in intellectual property law, major challenges still remain. The methods of interpretation and analysis of the Penal and Intellectual property law, and library resources have been used in the research to evaluate of conformity of standards of criminalization, and their applicability in the legal systems of Iran, France, and the United States. Findings demonstrates that criminal supporting in the fashion industry in the French and American systems is based on criminalization and attention has been paid to the economic nature and wealth creation of intellectual works, including intellectual creations in fashion, when determining the guarantee of execution. In Iran, however, inadequate standards of criminalization, copyright infringement, and determining the guarantee of appropriate execution have created challenges in the criminal supporting of fashion creations..
