چالش های حقوقی حفاظت از بستر و حریم رودخانه ها در ایران

افزایش تجاوز به بستر و حریم رودخانه‌ها به یک فرابحران تبدیل شده است. این تجاوز به شیوه‌های گوناگونی مانند ایجاد و احداث اعیانی‌های غیرمجاز، برداشت غیر قانونی و بی رویه شن و ماسه، تخریب رودخانه، تخلیه نخاله و زباله، حفر چاه و غیره صورت می‌پذیرد. عوامل متعددی اعم از وضع قوانین نامناسب، ضعف نظام اجرایی و مشکلات سیستم قضایی در بروز معضلات مزبور نقش اساسی داشته است. روش پژوهش حاضر توصیفی‌ تحلیلی و روش گردآوری داد‌ه‌ها، کتابخانه‌ای است. هدف پژوهش، شناسایی چالش‌های حقوقی که باعث شده تا حاکمیت وزارت نیر‌و به نمایندگی دولت بر بستر و حریم رودخانه‌ها متزلزل و زمینه تجاوز به بستر و حریم رودخانه‌ها تشدید گردد. نتایج حاصل از پژوهش نشان می‌دهد اجرای ناقص قانون توزیع عادلانه آب و آیین‌نامه‌های مربوطه، چند‌گانگی مدیریت بر بستر و حریم رودخانه‌ها، وجود خلاء‌های قانونی، فقدان سند مالکیت برای بستر رودخانه‌ها و دادرسی ناکارآمد آب در قبال متجاوزین سبب شده تا این ثروت عمومی جولانگاه تجاوز و تصرف قرار گیرد.

The Reflection on legal challenges Infringement to the river bed and Riparian Zone in Iran

Increasing infringement on the river bed and Riparian Zone, has become a Postcrisis. This violated in various ways is don, such as building and construction unauthorized, illegal removal and irregular of sand , disposal of rubbish and waste, destruction of the river,drilling of well and other ways. Several factors, including inadequate legislation, weak enforcement system and the problems of the judicial system has been pivotal in the development of the aforementioned problems.This research method analytical and data collection method is library. This study aims to identify legal challenges that led to the rule of the Ministry of Energy to represent the state on the river bed and Riparian Zone is shaken and field resonance speculation. The results of the study showed, the incomplete enforcement of the equitable distribution of water code and respective regulation , the multiplicity of management on the river bed, the existence of legal gaps, lack of legal title to the beds of rivers and Water Inefficient proceedings has led to the invasion and occupation of the public wealth outlet place.
