مسئولیت‌سنجی پزشکان جراح زیبایی با سه مبنای اماره تقصیر، نظریه تقصیر و تئوری خطر

مقدمه: غالباً حجم زیادی از جوانان و نوجوانان وقت و هزینه‌های هنگفتی را در باب جراحی زیبایی به خانواده‌ها و در نهایت جامعه تحمیل می‌کنند، بدون این که این اقدام منشا بیماری داشته و تامین‌کننده سلامت باشد. بلکه برعکس، چنانچه قوانین متعادل‌کننده و پیشگیرانه از بی‌رویه‌شدن این اقدامات تقنین نشود ضمن این که موجب تشکیل پرونده‌های عدیده قضایی می‌شود، جامعه پزشکی را هم برخلاف سوگندنامه آنها برای تامین سلامت جامعه، از مدار و رسالت اصلی خود خارج می‌کند. حال سئوال این است که کدام مبنای مسئولیت در خصوص پزشکان جراح زیبایی (محض) سازگارتر و به عدالت نزدیک‌تر است؟ لذا هدف این پژوهش، بررسی مسئولیت‌سنجی پزشکان جراح زیبایی با سه مبنای اماره تقصیر، نظریه تقصیر و تئوری خطر بود که به روش توصیفی تحلیلی با جست‌وجو در بین منابع مربوطه انجام شد.نتیجه‌گیری: از میان انواع مبانی مسئولیتِ پزشکان جراح زیبایی، در فرآیند کم و بیش پیچیده و پرفراز و نشیب اعمال پزشکی، تئوری خطر به عدالت و مصلحت اجتماعی جامعه هدف، نزدیک‌تر است.

Responsibility of Cosmetic Surgeons with Three Bases of Fault Statistics, Fault Theory and Risk Theory

Aims: Often, many young people and teenagers impose huge costs and time on families and society on cosmetic surgery, while their action is not based on the origin of the disease and doesn't provide health for them. Lack of balancing and preventive laws for the prevention of exceeding these actions causes numerous judicial cases and causes the medical community to ignore its original mission, in spite of their oath to ensure the health of the community. Now, the question is what basis of responsibility for cosmetic surgeons is more consistent and closer to justice? Therefore, the aim of this research was to investigate the responsibility of cosmetic surgeons with three bases of fault statistics, fault theory, and risk theory. The research was conducted with the descriptiveanalytical method by searching in the relevant sources.Conclusion: Among the types of principles of responsibility for cosmetic surgeons, in the more or less complicated process of medical practices, the risk theory is closer to the social justice and social interest of the target community.
