بازخوانی دیدگاه محسن کدیور درخصوص«مجازات مرتد و ساب النبی»

محسن کدیور در رساله نقد مجازات مرتد و ساب النبی ضمن نقد آراء برخی از فقهاء در مجازات حکم مرتد و ساب النبی، این مسئله را در مقام افتاء و اجراء حدود، صرفاً برعهده ولی فقیه دانسته و معتقد است اجراء حدود برفرض صحت آن باید در محکمه صالحه انجام پذیرد. وی همچنین بر این عقیده است اجرای حکم مرتد سبب وهن دین و مخالف آیات قرآن و عرف عقلاء می‌باشد. از دیگر مدعیات وی می‌توان به تغییر موضوع ارتداد نسبت به صدر اسلام اشاره کرد. مسئله این تحقیق آن است که آیا مجازات مرتد و ساب النبی سبب وهن دین و مغایر با رحمانیت اسلام است؟ روش تحقیق تحلیلی انتقادی بوده و یافته‌های تحقیق نشان می‌دهد که سیره عقلاء نمی تواند به تنهایی دلیل کافی بر وهن‌آمیز بودن مجازات مرتد باشد بلکه در تعارض با ادله عقلی و نقلی است و تغییر موضوع ارتداد نیز مستند قابل دفاعی ندارد.
