مفهوم شناسی ناموس در فقه و حقوق اسلامی

اصطلاح ناموس، با وجود کاربرد شایع آن، در متون فقهی، حقوقی اسلام و قوانین ایران، مفهوم واحد و روشنی از آن ارائه‌نشده که این امر، موجب ابهام در تعیین حقوق و تکالیف افراد می‌گردد؛ چرا که اجمال واژه‌ها طبیعتاً جمله را نیز مجمل می‌کند و در نتیجه، قواعد قابل اجرا ممکن است به خاطر اجمال در یکی از واژگان و دوپهلو بودن آن، مختل شود و به اجرا درنیاید. این مقاله در صدد مفهوم‌شناسی و بررسی کاربردهای مختلف ناموس، در متون فقهی، حقوقی اسلام و قوانین ایران به روش توصیفی- تحلیلی است. این پژوهش با بررسی کاربردهای مختلف این اصطلاح، در متون مذکور، به این نتیجه رسیده که تعریف جامع و مشخصی درباره محدوده افرادی که این واژه شامل آنها می‌شود، وجود ندارد، ولی قدر متیقن از بررسی کاربردهای مختلف، اطلاق آن، به بستگان اناث نسبی و سببی فرد از قبیل همسر، مادر، خواهر و دختر فرد است؛ گرچه در برخی کاربردها، به بستگان ذکور نیز اطلاق گردیده‌است، اما دایره شمولی آن نسبت به بستگان به صورت دقیق مشخص نشده‌است. هم‌چنین قدر متیقن از مفهوم اصطلاح هتک ناموس، عمل نامشروع جنسی است؛ گرچه در برخی کاربردها، رفتارهای دیگر از قبیل ملامسه از روی شهوت و... و حتی نسبت‌های ناروای جنسی به افراد نیز هتک ناموس تلقی شده‌است.

the term honor, despite its common use, in jurisprudence and islamic legal texts and iranian laws, a single and clear concept of it has not been presented, which causes ambiguity in determining the rights and duties of individuals; because abbreviating words naturally also summarizes the sentence, and as a result, applicable rules may be disturbed and not implemented due to the abbreviation of one of the words and its ambiguity. this article aims to conceptualize and examine the different uses of honor in islamic jurisprudence and legal texts and iranian laws in a descriptive-analytical way. by examining the various uses of this term in the mentioned texts, this research has come to the conclusion that there is no comprehensive and specific definition of the range of people that this term includes, but it is certain from the examination of the various uses that it is applied to relatives. the relative and causal females of a person such as a person’s wife, mother, sister and daughter; although in some applications, it is also applied to male relatives, but its inclusive circle has not been specified in detail. also, the meaning of the concept of defamation is an illicit sexual act; however, in some applications, other behaviors such as touching out of lust and... and even inappropriate sexual relationships with people are also considered as dishonor.
