تعلیق مراقبتی در قانون مجازات اسلامی؛چالش‌ها و راهکارها (مطالعه موردی محاکم کیفری استان خراسان رضوی)

با مروری کوتاه به نوع سیاست‌گذاری‌ها در حوزه‌ی پیشگیری و کنترل جرم به این نکته می‌رسیم که برخی از سیاست‌ها در کشور ما ریشه در ترجمه‌ی متون قانونی کشورهای غربی دارد. ازجمله‌ی این سیاست‌ها که وارد حوزه‌ی سیاست کیفری ایران شد نهاد تعلیق مراقبتی است؛ اما سیاست‌گذاری درزمینه ی چگونگی کنترل جرم و واردکردن سیاست از یک نظام کیفری و رسیدن به اهداف ترسیمی، علاوه بر رعایت الزامات آن، مستلزم همگونی و انطباق در داده‌های جامعه‌شناسی و سایر بسترهای اجتماعی و فرهنگی کشور واردکننده است. در کشور ما،علرغم اقتباس و تصویب نهاد تعلیق مراقبتی در قانون مجازات اسلامی سال 1392،توجهی به این دو مقوله (1-رعایت الزامات محتوایی 2-توجه به مقوله‌ی بومی‌سازی) نگردیده و این کمبودها در کنار عدم آموزش کافی به مجریان امر اولا محاکم را به صدور قرارهای ساده متمایل نموده و ثانیا در موارد استفاده، دستورهای صادره،بعضا از کیفیت مطلوب برخوردار نیست. در این تحقیق با در نظر گرفتن جنبه‌های الف(محتوایی/ نمادین) و ب) فرآیندی همگرایی در سیاست‌های کنترل جرم، چالش‌های به‌کارگیری تعلیق مراقبتی در نظام عدالت کیفری ایران شناسایی و سپس متناسب با نوع چالش‌ها، به ارائه‌ی راهکارهای عملی اقدام می‌گردد. در راستای این هدف، علاوه بر جمع‌آوری داده از منابع موجود و ادبیات تحقیق، از روش پیمایش و ابزار مصاحبه با جامعه آماری شامل 1- دادرسان محاکم 2- قضات اجرای احکام 3- محکومینی که مجازاتشان تعلیق گردیده و نیز مطالعه پرونده‌های تعلیقی شعبات کیفری بدوی و تجدیدنظر استان خراسان رضوی استفاده گردیده است.

the suspension of care in the legal system of the islamic republic of iran, challenges and solutions

how policies in the field of crime control and import policies from a penal system, requires a data assimilation and adaptation in sociology, social contexts, cultural and welfare of the importing country. a short review of policy in the field of prevention and control of crime in the criminal justice system reflects the fact that many of the policies in our country rooted in the translation of legal texts of western countries among these policies, due to the uncontrolled increase in court cases in courts of law of the proceedings has been entered iranian penal policy non-custodial penalties. in this research with consideration aspects a) content / symbolic b) convergence process in crime control policies challenges of applying suspension of care in iranian legal system identified then, depending on the type of challenges, practical solutions are provided. in line with this objective in the present study in addition to collecting data from existing sources and research literature from the survey method and interview tools and questionnaires with the statistic community including 1) trial judges 2) enforcement judges 3) convictions suspended and also study and review of 122 cases sent to one of the branches of the criminal sentences enforcement within one month use and after three steps of coding, statistical tests and frequency distribution table design, data analysis was conducted to examine the challenges and strategies for using this institution
