رای اعتماد جمعی به هیئت وزیران در نظام حقوق اساسی جمهوری اسلامی ایران

در قانون اساسی جمهوری اسلامی ایران بر لزوم پاسخ‌گویی قوه مجریه نسبت به مجلس تاکیده شده و راه‌های گوناگونی برای این پاسخ‌گویی در نظر گرفته شده است. یکی از این راه‌ها می‌تواند لزوم اعطای رای اعتماد جمعی به هیئت وزیران – یعنی رای اعتماد به کلیت مجموعه پیش از رای اعتماد به تک تک وزیران- باشد. مقاله حاضر در پی آن است تا با نگاهی توصیفی- تحلیلی به این پرسش پاسخ دهد که حکم رای اعتماد جمعی به هیئت وزیران در نظام حقوق اساسی جمهوری اسلامی ایران چیست. یافته مقاله آن است که وفق متن اصول متعدد، موضوع اعطای رای اعتماد جمعی به هیئت وزیران در قانون اساسی پیش‌بینی شده است، اما این امر نه در قوانین عادی و نه در رویه عملی مورد توجه جدی قرار نگرفته است. اگرچه این نحوه نظارت مجلس بر دولت، اصولاً از خصوصیت‌های نظام‌های پارلمانی است، اما قانون اساسی ما ترجیح داده تا در راستای هرچه بیشتر پاسخ‌گو کردن دولت به مجلس از آن بهره‌برداری نماید. بدین ترتیب، مجلس علاوه بر برنامه انفرادی هریک از وزرا، بر خط مشی کلی دولت نیز نظارت خواهد داشت.

in the constitution of the islamic republic of iran, the necessity of accountability of the executive branch to the parliament is emphasized and various ways have been considered for this accountability. one of these ways can be the need to give a collective vote of confidence to the cabinet - that is, a vote of confidence in the entire group before a vote of confidence in individual ministers. the present article seeks to answer the question with a descriptive-analytical view, what is the verdict of collective vote of confidence in the council of ministers in the constitutional law system of the islamic republic of iran. the finding of the article is that according to the text of several principles, the issue of giving collective vote of confidence to the council of ministers is foreseen in the constitution, but this issue has not been seriously considered either in the common laws or in the practical procedure. although this way of supervision of the parliament over the government is basically one of the characteristics of parliamentary systems, our constitution prefers to use it in order to make the government more accountable to the parliament. in this way, in addition to the individual program of each minister, the parliament will also supervise the general policy of the government.
