مبانی و مستندات فقهی و حقوقی شروع به جرم سرقت سایبری

با گسترش فضای مجازی و جرایم ارتکابی در این حوزه، تدوین قوانین جزایی اختصاصی برای این حوزه ضرورت یافت و قانونگذار ایران در سال 1388 قانون جرایم رایانه ای را به تصویب رساند که دو ماده آن به طور نامعین به سرقت و کلاهبرداری اختصاص پیدا کرد. در قانون مزبور شروع به جرم سرقت سایبری جرم محسوب نشده بود ولی با رویکرد قانون مجازات اسلامی مصوب 1392 در گسترش قلمرو شروع به جرم، این موضوع قابل بررسی است که آیا شروع به سرقت سایبری، جرم محسوب می شود؟ مبانی و مستندات فقهی و حقوقی آن چیست؟ و در صورت جرم بودن شروع به سرقت سایبری مجازات آن چیست؟ در این مقاله ضمن طرح دیدگاه های حقوقی، مستندات و مبانی فقهی و حقوقی شروع به جرم در سرقت سایبری مورد مطالعه و آسیب شناسی قرار گرفته است و این نتیجه حاصل شده است قانون در مجازات شروع به جرم در سرقت سایبری دارای ابهام است و نیاز به بازنگری در موضوع دارد.

with the expansion of cyberspace and crimes committed in this area, the development of specific criminal laws for this area became necessary and the iranian legislature in 2009 passed the law on computer crimes, two articles of which were indefinitely allocated to theft and fraud. in the mentioned law, committing the crime of cyber theft was not considered a crime, but with the approach of the islamic penal code adopted in 1392 in expanding the scope of committing a crime, it can be examined whether committing the crime of cyber theft is considered a crime? what are its jurisprudential and legal principles and documents? and if it is a crime to start cyber theft, what is the punishment? in this article, while presenting legal views, jurisprudential and legal documents and principles of committing a crime in cyber theft have been studied and pathologically, and this result has been obtained. there is a revision of the subject.
