ابهام ناشی از ناهمراستایی بیان تقنینی و ساختار نظام حقوقی (مطالعه موردی ماده 310 قانون مجازات اسلامی)

نظام ﺣﺎﮐﻢ ﺑﺮ ﺗﻌﺎﻣﻞ اﺟﺘﻤﺎﻋﯽ و ﺟﺎﯾﮕﺎه ﻏﯿﺮﻣﺴﻠﻤﺎﻧﺎن در ﺟﻮاﻣﻊ اﺳﻼﻣﯽ و ﭼﮕﻮﻧﮕﯽ ﺗﺒﯿﯿﻦ ﭼﻨﯿﻦ ﻧﻈﺎمﯽ از اﺑﻌﺎد ﻣﺨﺘﻠﻔﯽ ﻗﺎﺑﻞ ﺗﻮﺟﻪ اﺳﺖ. ﺳﯿﺮ اﯾﻦ تحولات در ﺗﺒﯿﯿﻦ ﻧﻈﺎم ﺗﻌﺎﻣﻠﯽ ؛ از ﺗﻨﻈﯿﻢ ﻗﺮادادی براسﺎس ﻋﻘﺪ ذﻣﻪ ﺗﺎ ﺗﻨﻈﯿﻢ ﻗﺎﻧﻮﻧﯽ ﺑﺮاﺳﺎس راﺑﻄﻪ ﺗﺎﺑﻌﯿﺖ را در ﺑﺮﻣﯽ ﮔﯿﺮد اﻣﺎ ﭼﺎﻟﺶ ﻣﻬﻤﯽ ﮐﻪ در ﻟﺴﺎن ﺗﻘﻨﯿﻦ ﺑﺎزﺗﺎب ﭘﯿﺪ ا ﮐﺮده و در ﻣﺎده 310 ﻗﺎﻧﻮن ﻣﺠﺎزات اﺳﻼﻣﯽ ﺑﯿﺎن ﮔﺮدﯾﺪه؛ ﻓﺎﺻﻠﻪ ﮔﻔﺘﻤﺎ ﻧﯽ ﻗﺎﻧﻮن ﮔﺬار ﺑﺎ ﺳﺎﺧﺘﺎر ﻧﻈﺎم ﺣﻘﻮﻗ ﯽ ﺟﻤﻬﻮری اﺳﻼﻣﯽ اﯾﺮان را ﺑﺎزﻧﻤﺎﯾﯽ ﻣﯽ ﮐﻨﺪ . ﭼﻨﯿﻦ ﺑﯿﺎ ﻧﯽ ﺑﺎ ﻓﻀﺎی ﻋﯿﻨﯽ و واﻗﻌﯿﺖ ﺳﺎﺧﺘﺎر ﺣﻘﻮﻗﯽ و ﺣﻘﻮق ﻋﻤﻮﻣﯽ ﻣﻄﺎﺑﻖ ﻧﯿﺴﺖ و ﺑﺎ اﺷﮑﺎل ﻧﺎﻫﻤﺎﻫﻨﮕﯽ و ﻧﺎﻫﻤﺮاﺳﺘﺎﯾﯽ ﺑﯿﺎن و ﺳﺎﺧﺘﺎر، و ﻫﻤﭽﻨﯿﻦ اﺑﻬﺎم ﻋﻤﻠﯽ روﺑﺮو اﺳﺖ. ﻣﻘﺎﻟﻪ ﺣﺎﺿﺮ درﺻﺪد واﮐﺎو ی و ﺑﺮرﺳﯽ ﭼﺎﻟﺶ ﺑﯿﺎن ﺗﻘﻨﯿﻨﯽ و ﺳﺎﺧﺘﺎر ﻧﻈﺎم ﺣﻘﻮﻗﯽ در ﺗﺒﯿﯿﻦ اﺻﻨﺎف و ﮔﺮوه ﻫﺎی غیرﻣﺴﻠﻤﺎن و ﻓﺎﺻﻠﻪ ﮔﻔﺘﻤﺎﻧﯽ ﻣﻮﺟﻮد در ﺷﺮاﯾﻂ ﺣﻘﻮﻗﯽ ﮐﻨﻮﻧﯽ اﺳﺖ.

types of non-muslim groups; the challenge of legislative expression and the structure of the legal system:the system that governs social interaction and the position of non-muslims in islamic societies and how to explain such a system is significant from various dimensions. the course of these developments in explaining the interactive system; it includes the contractual arrangement based on the obligation contract to the legal arrangement based on the citizenship relationship, but the important challenge that has been reflected in the language of the law and stated in article 310 of the islamic penal code; it represents the discursive distance of the legislator with the structure of the legal system of the islamic republic of iran. such an expression is not in accordance with the objective space and reality of the legal structure and public law, and faces forms of inconsistency and misalignment of expression and structure, as well as practical ambiguity.the present article seeks to analyze and investigate the challenge of legislative expression and the structure of the legal system in explaining the non-muslim guilds and the discursive distance existing in the current legal conditions.key words: legislation, minority, general rights of non-muslims, structure of the legal system, contract of obligation, non-muslim guilds.types of non-muslim groups.
