تحلیل اقتصادی سیستم های بررسی شرایط ثبت اختراع

ادارات ثبت اختراع در جهان غالباً جهت بررسی شرایط ثبت اختراع، یکی از دو سیستم اعلامی یا تحقیقی را بکار م یبرند. در سیستم اعلامی صرفا شرایط شکلی اظهارنامه ثبت اختراع ملاحظه می گردد اما در سیستم تحقیقی علاوه بر شرایط شکلی، شرایط ماهوی اختراع یعنی نو بودن، ابتکاری بودن و دارای کاربرد صنعتی بودن نیز مورد مداقه قرار م یگیرد. در این مقاله بر آنیم که با رویکرد تحلیل اقتصادی حقوق به این سوال پاسخ دهیم که آثار اقتصادی هر یک از این دو سیستم حقوقی بر نهادهای مرتبط چیست. اینتحقیق اثبات م یکند که اگرچه در نظر اول، سیستم اعلامی هزینه های ثبت را کاهش خواهد داد اما پس از ثبت، هزینه های به مراتب بیشتری نسبت به سیستم تحقیقی بر نهادهای مرتبط وارد می آورد. همچنین راه حل های ترکیبی یا جایگزینی وجود دارند که قادرند مجموع هزینه های مذکور را به حداقل برسانند.
