مبانی نظری مصونیت و مسئولیت مدنی دولت

امروزه مسئولیت مدنی برای اشخاص حقیقی و حقوقی حقوق خصوصی پذیرفته شده است ولی مسئولیت مدنی ناشی از اعمال دولت به مفهوم عام ، از مباحث تازه در حقوق عمومی به شمار می رود. ﺑﻨﯿﺎدی ﺗﺮﯾﻦ ﻣﻮﺿﻮع در زﻣﯿﻨﻪ ﻣﺴﺌﻮﻟﯿﺖ ﻣﺪﻧﯽ دولت ، ﻣﺒﻨﺎی ﻣﺴﺌﻮﻟﯿﺖ ﻣﺪﻧﯽ دولت اﺳﺖ و این مبنا خود ناشی از نظریات و اندیشه های فلسفی و نیز میزان تکامل و پیشرفت فرهنگ وتمدن حاکم بر یک نظام سیاسی و حقوقی است. از حیث مبانی نظری، بسیاری از نظریات و اندیشه های فلسفی، با تقبل اصل مسئولیت مدنی دولت ، مخالف بوده ویا موضع روشنی ندارند. در نظام حقوقی جمهوری اسلامی ایران، مسئولیت مدنی دولت به عنوان یک تئوری مطرح نشده است و قاعده کلی لزوم جبران خسارات وجود ندارد. علیهذا بایستیﺳﺎﺧﺘﺎر ﻗﻮاﻧﯿﻦ ﺣﻘﻮق ﮐﺸﻮر ﺑﺼﻮرت ﺷﻔﺎف، ﻣﺴﺌﻮﻟﯿﺖ ﻣﺪﻧﯽ دولت را روشن کند تا ﺷﻬﺮوﻧﺪان ﺑﺘﻮاﻧﻨﺪ ﺑﺎ اتکا به آن قوانین ،ﺣﻘﻮق ﺷﻬﺮوﻧﺪی ﺧﻮﯾﺶ را اﺳﺘﯿﻔﺎ نمایند.
