ماهیت اموال خارج از حاکمیت دولت‌ها از منظر فقه امامیه

اموال خارج از حاکمیت دولت‌ها در مناطقی شامل دریاهای آزاد، جو، ماورای جو و قطب جنوب واقع شده است. این اموال از جمله دریاها، منابع معدنی، آبزیان، حیوانات خشکی، مدارهای ماهواره‌ای، اجرام سماوی، جو و ماورای جو را شامل می‌شود. با توجه به گستره مفهوم انفال در فقه امامیه، می‌توان اموال خارج از حاکمیت دولت‌ها را به جز مواردی که موضوعاً از ذیل مفهوم انفال خارج می‌گردد، جزء انفال به حساب آورد؛ زیرا، اموال مذکور فاقد مالک معین بوده و ذیل عموم روایاتی قرار می‌گیرد که کل دنیا و آنچه در آن است را متعلق به امام می‌داند. بعلاوه، مصادیقی که در روایات تحت عنوان انفال بیان شده از باب تمثیل است و امکان توسعه این مصادیق در ادوار زمانی و مکانی مختلف وجود دارد. اموال خارج از حاکمیت دولت‌ها از جمله این مصادیق است که برای مدیریت آن در اختیار امام به عنوان حاکم جامعه اسلامی قرار دارد. این تحقیق از دو بخش تشکیل شده است. در بخش نخست مصادیق و مفاهیم حاکم بر اموال خارج از حاکمیت دولت‌ها تبیین و در بخش دوم به ماهیت آن پرداخته می‌شود.

The Nature of Properties outside of State Sovereignty via prospective of Imamieh Jurisprudence

Properties outside of sovereignty of states situated in the areas including the high seas, atmosphere, outer Space and Antarctic, comprises of sea, mineral resources, fish, land animals, satellite orbits, celestial bodies, atmosphere and outer space. With considering of the range of Anfal in Imamieh jurisprudence, the properties outside of sovereignty of states can take in to account under Anfal concept other than items are excluded for its subject. Because, the mentioned properties are without determined owner and are subject to the general narrates stated that all of world is belonging to Imam (Leader of Shia). Furthermore, the cases stated in narrations as Anfal, are as sample, so we can expand the number and items of Anfal during the various times and places accordingly, then the properties outside of sovereignty of states are an instance of the Anfal examples which are under the authority of Imam as leader of Islamic Society due to managing of them.This essay comprises of two part. The first is inclusive of items and concepts over the properties outside of sovereignty of states and second part is related to the jurisprudence nature of these properties.
