مبانی نظری سیاست جنایی در قبال مفاسد اقتصادی

با وجود گذشت نزدیک به دو دهه از شیوع کاربرد اصطلاح مفاسد اقتصادی افزون بر ابهام در معناشناختی مفاسد اقتصادی، مبنای مبارزه با آن نیز به درستی تبیین نشده است و این‌دو نقص سبب شده تا سیاست جنایی مشخصی در قبال این پدیده مجرمانه وجود نداشته باشد. آشفتگی، پراکندگی و عدم انسجام در مقررات کیفری، حکایت از فقدان سیاست جنایی و استراتژی مشخص در قبال مفاسد اقتصادی دارد. این نوشته با روش مطالعه نهادی با ارائه تعریفی از مفاسد اقتصادی، وجه تمایز آن را با عناوین مشابه مشخص می‌نماید و در پی آن، مبنای سیاست جنایی اسلام و جمهوری اسلامی ایران در قبال این بزه را حفاظت از امنیت اقتصادی معرفی می‌کند که ترکیبی از مولفه‌های مختلف اقتصادی و محیط اقتصادی چون عدالت اقتصادی و امنیت قضایی بوده و افزون بر تایید مبانی دینی، سابقه در اسناد بالادستی جمهوری اسلامی ایران را نیز دارد.
