چالشهای قانونی خدمات توانبخشی در ایران مطابق چارچوب مدل کارکردهای نظام سلامت سازمان بهداشت جهانی

سردبیر محترم،خدمات توانبخشی، بخشی از خدمات سلامت است که تدارک آن برای همه مردم متناسب با نیازشان برعهده نظام سلامت گذاشته شده است. براساس تاکید سازمان ملل متحد، ارائه این خدمات باید دسترسی عادلانه، با کیفیت و حمایت از افراد در برابر هزینه‌های سلامت را تضمین کند [1]. به علاوه ایران نیز مانند سایر کشورها متعهد دستیابی به پوشش همگانی سلامت بوده و در این راستا در زمینه خدمات توانبخشی اسناد و قوانین بسیاری مصوب کرده است [2]. از جمله چالش های قانونی موجود در حوزه توانبخشی برای معلولان در ایران مسئله تولیت است. مشکلات تولیت در ایران شامل سیاست و قوانین نامتوازن، مداخله غیرمسئولانه، ضعف نظارت همه جانبه، فقدان مدیریت مدبرانه و دلسوزانه و ناهماهنگی درون و بین‌بخشی هستند، در واقع تولیت حلقه گمشده کار تیمی در خدمات توانبخشی ایران است [3،4]. متولی اصلی تولیت توانبخشی در ایران سازمان بهزیستی بوده، ولی در اغلب کشورها وزارت سلامت متولی است [5]. گزارش سال 2019 سازمان جهانی بهداشت نیز بر تولیت‌گرایی بخش سلامت بر توانبخشی تاکید کرده است [6]. در جهت تحقق اصول 21 و 29 قانون اساسی از سال 1359 با تصویب شورای عالی انقلاب اسلامی، مسئولیت ارائه خدمات توانبخشی به سازمان بهزیستی کشور واگذار شد. از طرفی برای اولین بار در سیاست های کلی سلامت از سوی مقام معظم رهبری در سال 1393، به مسئله خدمات توانبخشی توجه جدی شد و وزارت بهداشت به عنوان متولی ساماندهی خدمات توانبخشی تعیین گردید و در همین راستا اداره کل امور توانبخشی ایجاد شد. همچنین سازمان هلال احمر نیز به طور مستقل خدمات توانبخشی را از طریق مراکز ارتوپدی فنی و کلینیک های توانبخشی تحت نظارت معاونت درمان و توانبخشی خود ارائه می‌کند. ساختار تولیتی می‌تواند به صورت متمرکز، غیرمتمرکز و ترکیبی باشد که در ایران اغلب متمرکز است [7]....

legal challenges of rehabilitation services in iran: the framework of the health system functions model of the world health organization

similar to many countries, iran is committed to achieving universal health coverage. as such several laws have been approved regarding rehabilitation services. examining these laws shows that there are many legal challenges in the functions of the health system including procurement, financing, resource production, service delivery and accountability, and service quality. also, the problems of governance in iran include unbalanced policies and laws, irresponsible intervention, weak all-round supervision, lack of thoughtful and compassionate management, and inconsistency within and between departments. in addition, rehabilitation financing in iran is unbalanced. in the third chapter of the law of the sixth development plan, the challenges and problems of supportive institutions, especially the lack of credit and coverage gaps were brought into attention. it was emphasized that the needs cannot be met with direct support approaches. contrary to many countries that have specific laws for recording and analyzing information for disabled people, iran is in its initial stages of forming a database for them. furthermore, the comprehensive law on the protection of the rights of the disabled in 2013 is not a right-oriented law emphasizing the recognition, and does not guarantee their rights equal to ordinary people; instead, it has a welfare perspective on the issue. the presence of government organizations such as ministry of cooperatives, labor and social welfare, and the national welfare organization has caused the law to become a support-economic with the dominant discourse of rehabilitation instead of empowering disabled people and becoming a budget-oriented law.
