فرآیند های اجرای عدالت انتقالی برای حفاظت از کرامت انسانی و اخلاقی ملل با تاکید بر نقش دیوان بین المللی کیفری

زمینه: عدالت انتقالی رویکردی است به نقض سیستماتیک یا گسترده حقوق بشر که از یک سو برای بزه دیدگان ناشی از جفای سیستم حاکمیتی گذشته جبران خسارت می‌کند و از سوی دیگر فرصت‌هایی را برای تغییر نظام‌های سیاسی، کاهش و از بین بردن خشونت ها و سایر شرایطی که ممکن است ریشه این نا بسامانی ها  بوده‌اند ایجاد و یا افزایش خواهد داد.محققان در پژوهش حاضر بدنبال تبیین فرآیندهای اجرای عدالت انتقالی برای حفاظت از کرامت انسانی و اخلاقی ملل می باشند و به دنبال یافتن پاسخی برای این سوال هستند که دیوان بین المللی کیفری چه نقشی در این زمینه ایفا کرده است؟نتیجه گیری: رویکرد عدالت انتقالی برای حفاظت از کرامت انسانی و اخلاقی شهروندان، در دوره انتقال دارای دو هدف عمده است: اولین گام، به دست آوردن سطحی از عدالت برای قربانیان است و گام دوم تقویت امکانات برای صلح، دموکراسی و آشتی خواهد بود. برای دستیابی به این دو هدف، اقدامات عدالت انتقالی اغلب در قالب عناصر عدالت کیفری و ترمیمی، ترکیب و بستر سازی می شود. با تاسیس دیوان بین المللی کیفری ، این دیوان علاوه بر وظیفه اصلی خویش در تعقیب و مجازات مجرمان، در موضوع عدالت انتقالی نیز به دنبال عدالت ترمیمی جهت تثبیت و تحکیم صلح و ثبات، پس از گذار از حاکمیت ناقض می باشد که چهارچوبی ساختارمند برای حقیقت یابی، عفو و مجازات تدوین می نماید.
