زمینه: حدود و نحوه اجرای مجازات در خصوص همه افراد یکسان نیست و همیشه این پرسش مطرح بوده است که آیا می‌توان از لحاظ مسئولیت اخلاقی برای طفل مجازاتی تعیین کرد یا خیر؟ پژوهش حاضر به مفهوم‌شناسی دقیق واژه طفل  پرداخته و مسئولیت اخلاقی در مجازات های مرتبط با اطفال را به تفصیل مورد بررسی قرار داده است.  نتیجه‌گیری: زیرساخت‌های حقوقی و اخلاقی برای مجازات کودکان متناسب با سن، توسعه روانی و قابلیت فهم آنها تعیین می‌شود. هدف اصلی در مورد کودکان باید آموزش، تربیت و بازسازی رفتار مناسب باشد تا به آنها بتوان ارزش‌ها و مسئولیت‌های اخلاقی را آموخت. مجازات‌هایی که برای کودکان اعمال می‌شود، باید منصفانه، اندازه‌گیری شده و با رعایت حقوق کودکان برخورد کنند. در عین حال، مواردی که به خلاف قوانین جرم ارتکاب می‌شود و کودکان نیز مسئول هستند، ممکن است نیاز به اقدامات اصلاحی داشته باشد. در هر صورت، توجه به حقوق کودکان و تامین محیطی سالم و ایمن برای رشد و تحول آنها بسیار حائز اهمیت است.
