زمینه: در حقوق کیفری جرم انگاری به فرایندی اطلاق می‌شود که مقنن با در نظر گرفتن هنجارها و ارزشهای اساسی جامعه و با تکیه بر مبانی نظری مورد قبول ، فعل یا ترک فعل‌هایی را ممنوع اعلام و برای آن ضمانت اجرای کیفری وضع می کند .در این مقاله با بررسی این فرایند و ضرورتهای مداخله کیفری در مباحث مرتبط با جرائم جنسی، چرایی و چگونگی این مداخله ، به بررسی و تبیین مبانی نظری مصلحت‌هایی که منجر به جرم‍انگاری جرایم جنسی و مداخله کیفری و نقش مبانی اخلاقی در لزوم یا عدم لزوم دخالت کیفری، پرداخته خواهد شد .نتیجه گیری:  تحلیل ارائه شده در این مقاله نشان می‌دهد که چگونه مبانی اخلاقی ممکن است برای افزایش درک ما از نگرش های عمومی و پاسخ‍های اجتماعی به جرائم جنسی موثر واقع شوند. مبانی اخلاقی می تواند از طریق برقراری ارتباط موثر با مردم در مورد راهکارهای مناسب برای کاهش بزه‌دیدگی جنسی در جامعه ، به ترویج سیاست‌های مترقی و مبتنی بر حمابت اجتماعی از جرم‌انگاری و مداخله حمایت‌گرانه از جرائم جنسی بپردازد.
