بررسی ابعاد اخلاقی مسئولیت مدنی دولت نسبت به زیست جهانی

زمینه: مسئولیت یک مولفه اخلاقی است. پاسخگویی معمولاً از مسئولیت ناشی می شود که مطابق با آن فرد از لحاظ قانونی در قبال صدمه‌ای که به دیگری وارد کرده است مسئول می‌باشد. یکی از مهم‌ترین بخش‌های حقوق مدنی، مسئولیت مدنی است و با توجه به اینکه هدف اصلی قواعد مسئولیت مدنی جبران خسارت‏های مادی و معنوی زیان دیده و ترمیم زیان وارده می باشد، دولت نیز از این قاعده مستثنی نمی باشد. بدیهی است گاه این مسئولیت بعدی جهانی می یابد و دولت ها را ملزم به پاسخگویی می کند. در مقاله حاضر سعی شده است تا ابعاد اخلاقی مسئولیت مدنی دولت ها نسبت به « زیست جهانی» تشریح شود .نتیجه گیری: بررسی مسئولیت کشورها از منظر اخلاق و آرا و رویه های قضایی، از ضروریات حفاظت و بهره برداری از زیست جهانی محسوب می گردد. مسئولیت بعدی اخلاقی است و اخلاقیات جای گرفته در بطن مسئولیت مدنی دولت ها، بر طیفی از مبانی ارزش ذاتی قرار دارند که انسان محوری و زیست بوم محوری، دوسر آن را تشکیل می دهند. در سال های اخیر تعامل مناسب انسان با جهان و راه حل بحران های جهانی در بازگشت به مبانی رویه های قضایی در نظام بین الملل جستجو می شود. در مقایسه با سایر کشورهای جهان متاسفانه باید اعتراف کرد که کشور ایران تاکنون در این زمینه به واسطه  مشکلات ناشی از آلودگی محیط زیست و آسیب به زیست جهانی ، عدم پاسخگویی دولت و ناکارآمدی نظام قضایی کارنامه قابل قبولی نداشته. بنابراین لازم است، با طراحی و توسعه اقدامات پیشگیرانه و تصویب قوانین و مقررات دقیق و جامع در این زمینه، از آسیب به زیست جهانی جلوگیری کرد.

background: responsibility is a moral component. liability usually arises from liability, according to which the person is legally liable for the damage he or she has caused to another. one of the most important parts of civil law is civil liability, and since the main purpose of civil liability rules is to compensate for material and moral damages and to repair the damage, the government is no exception to this rule. obviously, sometimes this responsibility takes on a global dimension and obliges governments to be accountable. this article attempts to describe the ethical dimensions of governments’ civil liability for biosphere.conclusion: examining the responsibility of countries from the perspective of ethics, opinions and judicial procedures is one of the necessities of protection and exploitation of the world environment. the next responsibility is moral, and the ethics embedded in the civil liability of governments are based on a range of intrinsic value principles that are twofold in human-centered and ecological-centered. in recent years, proper human interaction with the world and the solution of global crises have been sought in returning to the foundations of judicial procedures in the international system. compared to other countries in the world, unfortunately, it must be admitted that iran has not had an acceptable record in this field due to the problems caused by environmental pollution and damage to the world environment, the lack of accountability of the government and the inefficiency of the judiciary. therefore, it is necessary to prevent damage to the global environment by designing and developing preventive measures and adopting precise and comprehensive laws and regulations in this field.
