رسیدگی به اختلافات گمرکی در پرتو مقررات اقتصادی و ملاحظات اخلاقی بازار

زمینه: گمرک در دنیای تجارت امروز یکی از مهم ترین ارکانی است که به تنظیم روابط بازرگانی میان اشخاص حقیقی و حقوقی، حقوق خصوصی، عمومی و بین المللی می پردازد. از جمله بازیگران این عرصه علاوه بر دولت ها و شرکت های ملی و فرا ملی، پدیده ای نو ظهور به نام بازار است. بازار نقش مهمی در توجه به ارزش ها در فعالیت های اقتصادی و گمرکی دارد و زمانیکه در تعاملات اقتصادی ضمن حفظ ارزش ها امکان دسترسی به بازارهای اخلاقی فراهم شود اقتصاد اخلاقی شکل می گیرد. با توجه به اهمیت گمرک و بازارهای اخلاقی در اقتصاد مقاله حاضر با هدف مروری بر راه های رسیدگی به اختلافات گمرکی در پرتو مقررات اقتصادی و ملاحظات اخلاقی بازار شکل گرفت.نتیجه گیری: اعمال حق آزادی تجارت اما به عنوان یک آموزه ی لیبرال از نسل های حقوق بشر، خواه نا خواه، سبب ایجاد برخی نا برابری ها در عرصه ی اجتماعی و فعال شدن دولت ها و نظام های صنفی برای کنترل و نظارت قانونی بر مناسبات اقتصادی جامعه شده است. در این خصوص، نقش افرینی تنظیم مقررات اقتصادی با توجه به ملاحظات اخلاقی بازار در رسیدگی های گمرکی که توسط نهادهای اداری و شبه قضایی مدیریت می شود، امری مهم و تاثیر گذار تلقی می گردد. بررسی ها نشان می دهد تاثیر گذاری تنظیم مقررات اقتصادی و توجه به ملاحظات اخلاقی بازار در حل دعاوی گمرکی حقوق ایران از منظر ماهوی شامل تحلیل اقتصادی حقوق مقرراتی و تطبیق با اصول حکم رانی شایسته و از منظر تحلیلی بر نقش دادرس فعال در نظم رگولاتوری و اهمیت توجه به قانون در رسیدگی به اختلافات گمرکی است.

background: customs in the world of business today is one of the most important pillars that regulates trade relations between individuals and legal entities, private, public and international law. among the actors in this field, in addition to national and transnational governments and companies, there is a new phenomenon called the market. the market plays an important role in considering values ​​in economic and customs activities, and a moral economy is formed when economic interactions, while preserving values, allow access to ethical markets. given the importance of customs and ethical markets in economics, the present article was formed with the aim of reviewing ways to address customs disputes in the light of economic regulations and market ethical considerations.conclusion: exercising the right to freedom of trade, but as a liberal teaching from the generations of human rights, whether or not, causes some inequalities in the social arena and activates governments and trade union systems to legally control and monitor relations. the economy has become a society. in this regard, the role of economic regulation is considered important and effective in the customs proceedings, which are managed by administrative and quasi-judicial institutions, according to the ethical considerations of the market. studies show the effectiveness of economic regulation and attention to market ethical considerations in resolving customs lawsuits of iranian law from a substantive perspective, including economic analysis of regulatory law and compliance with the principles of due diligence and from an analytical perspective on the role of active judges in regulatory order and importance. pay attention to the law in handling customs disputes.
