مدیریت و نظارت دولت بر معادن همواره مورد توجه بوده است و در برخی از مواقع با توجه به تغییر و تحولات متعدد قانونی در طول زمان و یا نظریات فقهی در باب مالکیت، منشا نظارت‌های دولت بر معادن نیز مورد تفاسیر مختلفی قرار گرفته و در برخی موارد ممکن است این شبه پیش آید که به رسمیت شناختن مالکیت بر معادن یا به عبارت صحیح اعطای حق انتفاع که در قوانین پیش‌بینی شده است موجب زوال حاکمیت و نظارت دولت بر معادن خواهد بود، بنابراین برای کمک به فعالان این حوزه ضروری است که با بررسی قوانین این موضوع رفع ابهام شود و در ادامه نوع و حدود نظارت دولت بر این گنجینه‌های الهی با توجه به صلاحیت‌های مصرحه در قوانین مشخص شود. در این مقاله ابتدا به بررسی قوانین در خصوص نظارت دولت بر معادن و نحوه اعمال آن پرداخته می‌شود و در پایان ضمن نفی مالکیت و پذیرش وجود حق انتفاع معادن بیان می‌شود. با این که در قوانین بهره‌برداری از معادن توسط افراد مجاز است اما دولت با وضع قوانین خاص و منوط کردن بهره‌برداری افراد به اخذ مجوزهای قانونی، نظارت استصوابی خود را اعمال می‌کند.
