تاملی بر جایگاه عدالت در پیوند حقوق و اقتصاد

امروزه با گسترش جوامع بشری شاهد شکل‌‌گیری نهاد‌‌ها و سازمان‌‌ها با کارکردهای نوین حقوقی هستیم که تنظیم و تدوین قوانین حاکم بر آنها با رویکرد حقوقی صرف، ناروا عنوان شده و موجب دخالت علم اقتصاد و به‌تبع آن تحلیل اقتصادی حقوق شده است. تحلیل‌‌هایی که با هدف ایجاد یا افزایش عدالت و کارایی گاه سبب ورود محدودیت‌‌هایی بر اجرای حقوق و آزادی-های افراد می‌‌شود. این پیگیری کارایی این نگرش را در ذهن برخی ایجاد نموده است که تحلیل اقتصادی حقوق در تعارض با عدالت می‌باشد که به‌عنوان مبنا و هدف قواعد حقوقی است؛ اما مدافعان تحلیل اقتصادی حقوق، نه‌تنها معتقد به هیچ تعارضی نبوده، بلکه توجه به نگرش تحلیل اقتصادی را امری ضروری در تدوین و اصلاح قوانین به‌منظور تامین هر چه مناسب‌‌تر عدالت اجتماعی می‌‌دانند. مقالۀ پیش رو با اتخاذ روش توصیفی‌ تحلیلی، درصدد تبیین رابطه تحلیل اقتصادی حقوق با مبانی عدالت و تعیین جایگاه این نگرش در امر قانون‌‌گذاری است. نتایج نشان می‌دهد استفاده از نگرش تحلیل اقتصادی حقوق افق‌‌های جدیدی را برای تحول در حقوق (در راستای تحقق هرچه شایسته‌‌تر عدالت) در اختیار قوه مقننه قرار می‌‌دهد و شایسته است از ظرفیت‌‌‌های آن در امر قانون‌‌گذاری و اصلاح قوانین بهره برده شود.

a reflection on the place of justice in the link between law and economy

today, with the expansion of human societies, we are witnessing the formation of institutions and organizations with new legal functions, which the regulation and formulation of the laws governing them with a purely legal approach, has been called unjust and has caused the involvement of economics and, asa result, the economic analysis of law. analyzes that aim to create or increase justice and efficiency sometimes cause restrictions on the implementation of people's rights and freedoms. this pursuit of efficiency has created this attitude in the minds of some that the economic analysis of rights is in conflictwith justice, which is the basis and goal of legal rules; but the defenders of the economic analysis of rights, not only do not believe in any conflict, but also consider it necessary to pay attention to theperspective of economic analysis in formulating and amending laws in order to ensure social justice asmuch as possible. the following article, by adopting the descriptive-analytical method, tries to explain the relationship between the economic analysis of rights and the principles of justice and determine theposition of this attitude in the legislation. the results show that the use of the perspective of the economicanalysis of rights provides new horizons for the transformation of rights (in the direction of achieving justice as much as possible) and it is appropriate to take advantage of its capacities in the matter of legislation and amending laws.
