مفهوم لایحه قضایی

در بند 2 اصل 158 قانون اساسی یکی از وظایف رییس قوه قضاییه تهیه لوایح قضایی متناسب با جمهوری اسلامی تعیین شده است. اما، در اصل 74 همان قانون ابتکار قانونگذاری به ارایه لایحه قانونی وسیله هیات وزیران و طرح قانونی به پیشنهاد 15 تن از نمایندگان مجلس شورای اسلامی منحصر گردیده است. لایحه قضایی در قانون اساسی و قوانین عادی تعریف نشده و امکان ارایه آن از سوی رییس قوه قضاییه ناممکن یا حداقل مسکوت است. شورای نگهبان با ارایه نظریات تفسیری و مجلس شورای اسلامی با تصویب قانون اختیارات رییس قوه قضاییه هریک به سهم خود کوشیده‌اند پاسخی درخور به این پرسش‌ها ارایه دهند که مفهوم و محتوای لایحه قضایی چیست؟ آیا رییس قوه قضاییه می‌تواند راسا نسبت به تقدیم لایحه قضایی به مجلس مبادرت نماید و اینکه ایا هیات وزیران مجاز است لوایح ارسالی از سوی رییس قوه قضاییه را بررسی و احتمالا تغییر دهد در این مقاله کوشش شده مسایل فوق تا حد امکان بازنمایی شود و میزان قوت و ضعف آنها مورد بررسی قرار گیرد و مدخلی برای فحص و بحثهای بعدی در جوامع علمی تمهید کند.

the concept of judicial bill

According to article 158 (2) constitution, the head of the judiciary branch is responsible for Drafting judiciary bills appropriate for the Islamic Republic. So however according to article 74 government bills are presented to the Assembly after receiving the approval of the Council of Ministers. Members' bills may be introduced in the Islamic Consultative Assembly. Neither constitution nor ordinary laws didn’t definite Judiciary bill and competency to bring it by the head of the judiciary branch is unable or at list is silent. The Guardian Council by issuing interpretation and the Assembly by legislation on authorities of the head of the judiciary branch tried to answer to questions as fallow: what is the concept and contain of judiciary bill? Dose the head of the judiciary branch competence initially to present judiciary bills to Assembly? This essay try to review mentioned problems and questions and to examine them for future research and debats.
