نقش و کارکرد کمیسیون رسیدگی به اختلافات ناشی از اراضی ملی از منظر اصول دادرسی منصفانه

شناخت نقش و کارکرد کمیسیون ماده واحده به‌عنوان یک نهاد حقوقی قضایی،در کنار ملاحظات اقتصادی و فرهنگی کلان‌شهرها که منجر به ساخت‌وسازهای غیرمجاز حاشیه‌ای در این مناطق گردیده و تنفس‌گاه‌های طبیعی آن‌ها را نابود کرده است، ضرورت توجه و بازبینی به نقش و کارکرد کمیسیون ماده واحده را در نظام حقوقی کشور نمایان می‌سازد. مطالعه حاضر با توجه به مطالب پیش‌گفته و ضرورت بازبینی در مبانی قانونی و ساختاری کمیسیون ماده واحده، فرآیند تصمیم‌گیری و آیین رسیدگی آن را از منظر اهم اصول دادرسی منصفانه مورد مطالعه قرارداده است؛ تا از این رهگذر میزان کارایی و اثربخشی این مرجع اداری اختصاصی و موارد نقصان آن تبیین گردد و نقاط ضعف آن برای اصلاح و بازبینی در پیش چشم قانون‌گذاران قرار گیرد.

The Role and Functioning of the National Lands Disputes Commission from the Perspective of a Fair Trial

Understanding the role of the Commission of single article as a legal entity the legal, economic and cultural considerations in the metropolises, that leads to a marginal and illegal construction in these areas and the destruction of their natural environment, reveals the necessity to review the role and functioning of the commission of single article in the Iranian legal system. According to the above mentioned points and the need to review the legal and institutional foundations of the commission of single article, this article examines its procedure and decisionmaking process based on the the most important principles of a fair trial, in order to determine the efficiency and deficiencies of this administrative authority, so that its weaknesses are identified for review by the legislators.
