بنیان اجرای حقوق بشردوستانه: تعهد دولتها به رعایت و تضمین رعایت حقوق بشردوستانه

آنجاکه زمینۀ اعمال قواعد حقوق بشردوستانۀ بین المللی در پهنۀ جنگ هایی امکان پذیر است که چهره خود را با پیشرفت فنون رزمی و شیوههای نبرد گونهگون مییابد، گاه قواعد این رژیم از جمله ماده یک مشترک کنوانسیونهای ژنو نیز ناگزیر دستخوش تحولاتی می شود که آنها را از مبادی اولیه بسیار متفاوت میسازد. مطابق ماده یک مشترک کنوانسیونهای چهارگانه ژنو و پروتکلهای اول و سوم الحاقی بدانها، دولت های متعاهد ملزم به رعایت و تضمین رعایت مقررات مندرج در آنها هستند که البته حقوق بین الملل معاصر آن را قاعده ای عرفی به شمار میآورد. با وجود استقبال از این تعهد در برخی اسناد حقوق بشری، به اقتضای ضرورت و واقعیت روابط بینالمللی، تفاوتهایی میان آثار درج این تعهد در اسناد حقوق بشری و اسناد حقوق بشردوستانه ملاحظه میشود. در این مقاله پس از طرح مباحث نظری، به بررسی مصادیق رعایت تعهد مزبور خواهیم پرداخت و سعی ما بر آن است تا در قالب مطالعه برخی موارد عینی، کنش متقابل آنها در اجرای این اصل و وضعیت جاری آن در حقوق بین الملل فعلی را نیز تجزیه و تحلیل کنیم.

The Foundation of International Humanitarian LawEnforcement:State Obligations to Respect and to Ensure Respect

International Humanitarian Law is considered as a legal regime whose governing rules are being changed particularly as a result of the transformation of international and noninternational armed conflicts. But noticeably, the stability of humanitarian law enforcement has more or less constantly survived. In other words, nearly all states feel to have an obligation to adhere strictly to the rules, which reflects in common article 1 of 1949 Geneva conventions and some consequent Protocols. It reads: “The High Contracting Parties undertake to respect and to ensure respect for the present Convention [this Protocol] in all circumstances.” Accordingly, there are many areas in which all parties should establish and anticipate sufficient actions and mechanisms e. g. passing some Acts and Regulations, instructing military forces how to act, and punishing the perpetrators of certain crimes for their commission. Presently, to respect and ensure respect are undoubtedly applicable on varying entities beside states. This article proceeds to discuss the common article and some challenging dimensions.
