مبانی حقوقی دولت مدرن؛ ایده «ارجاع دولت به مفهوم اعتزالی حق»

حق، ادعایی استحقاقی (غیر امتنانی) و بر منزلت و شرافت انسانی مبتنی است. این مفهوم همچون شمشیری در کف زنگی مست، مبنایی برای نوزایی دولت و یا نظم سنتی است. در این میان، الاهیات اعتزالی برخلاف رویکرد خوارجی و یا اشعری، در عین تلاطم و کشاکش، مفهومی از حق را داراست که کاتالیزوری برای محاق نظم سنتی دولت و پیش‌برنده به سوی دولت مدرن خواهد بود. موضوع طرح شده، مبتنی بر مطالعات کتابخانه‌ای و رویکرد توصیفی تحلیلی، به فهم شکل حق در رویکرد اعتزالی و تاثیر آن (آنچنانکه هست) بر تکوین دولت مدرن می‌پردازد. این معنا از حق بی‌آنکه دولت مدرن را ماهیتی ثانوی در نظر بیانگارد، زمینه‌ای معرفتی برای تکوین دولت مدرن فراهم می‌سازد (بی‌آنکه منسلخ از عوامل عینی باشد). این معنا در کنار واگرایی اسلام از دولت مدرن در ابعاد سرزمینی، قدرت‌گرایی و نمودهایی چون رعیت، به تفکیک حوزه عمومی از خصوصی نظر داشته و به تکوین دولت مدرن، چه در عصر خود و چه پس از آن در نظریات نواعتزالی دامن می‌زند. این تحقیق، مبانی نظریه دولت مدرن را در مفهوم حق می‌داند که از حیث وقوعی با قبض و بسط همراه شده است.

Legal Foundations of Modern State; The Idea of Referring State to the Concept of Etzali Right
