امکان‌سنجی تجمیع صندوق‌های بازنشستگی در نظام تامین اجتماعی ایران

یکی از سازکارهایی که در نظام حقوقی ایران برای نظارت بر صندوق های بازنشستگی و ایجاد هماهنگی میان آنها پیش بینی شده، تجمیع صندوق های بازنشستگی است. تجمیع صندوق ها به معنای جمع شدن صندوق ها با حفظ شخصیت حقوقی خود زیر نظر یک نهاد برتر، آثار مطلوب متعددی به همراه خواهد داشت. این مقاله که با هدف امکان‌سنجی تجمیع صندوق های بازنشستگی ایران به رشته تحریر در آمده است در سه بخش به ترتیب به بررسی ضرورت ها، منابع و مراجع صلاحیتدار و موانع تجمیع صندوق ها پرداخته است. بررسی های مقاله نشان می دهد به دلایلی چون ناهماهنگی میان صندوق ها، فقدان نظارت موثر بر آنها و نیز نایده گرفته شدن برخی سیاست های دولت توسط صندوق ها، تجمیع آنها در وضعیت کنونی، ضرورت دارد. با این حال با وجود آنکه بسترهای قانونی این اقدام در ایران تا حد زیادی فراهم است اما در این راه موانعی چون تعارض تجمیع با استقلال صندوق ها، تعارض با سیاست کوچک‌سازی دولت و مخالفت مدیران عالی نیز وجود دارد.

The Feasibility Study of Aggregation of Pension Funds in Iran’s Social Security

One of the mechanisms that is foreseen in the Iranian legal system to monitor retirement funds and to create synergies between them is the aggregation of retirement funds. Combining funds in terms of pooling of funds by maintaining their own legal personality under the supervision of a superior institution will lead tomultiple desirable effects. The present article, which aims to study the feasibility of aggregation of Iranian retirement funds, has been reviewed in three sections in order to examine the necessities, sources and authorities and the obstacles before aggregating funds. The results suggest that it is necessary for their integration in the current situation due to the lack of coordination between the funds, the lack of effective monitoring thereof, as well as the disregard of some government policies by the funds. However, although the legal framework for this action is largely available in Iran, there are obstacles such as the conflict of aggregation with the independence of the funds, the conflict with the policy of downsizing the government and the disapproval of highranking officilas.
