دکترین «حمایت برابر»: تزلزل در اصل «تفکیک» در نظام مسوولیت بینالمللی سازمانها

چکیده
|
شخصیت حقوقی سازمانهای بینالمللی مستقل از اعضای آنها است. بر اساس اصل تفکیک مسئولیت در حقوق بینالملل، سازمان در قبال اعمال متخلفانهاش مسئول شناخته میشود و دولتها به صرف عضویت در سازمان مسئولیتی ندارند. با وجود این، رویه دیوان اروپایی حقوق بشر خصوصا در پرونده بسفروس از جهت تخدیش اصل کلاسیک تفکیک مسئولیت سازمان از اعضا می تواند مورد توجه قرار گیرد. در این پرونده، دیوان اروپایی حقوق بشر به دنبال مشخص کردن این مساله بود که چه زمانی دولتهای عضو مسئول اعمال انجام شده تحت لوای اتحادیه اروپا هستند. دکترین حمایت برابر که در رویه دیوان اروپایی حقوق بشر و به طور خاص در پرونده بسفروس مطرح شده، موجب تزلزل اصل تفکیک شخصیت و مسئولیت سازمان بینالمللی شده است و استثنایی بر آن وارد می کند. به موجب این دکترین، دولتهای عضو اتحادیه اروپا در صورتیکه در راستای ایفای وظایف خود در قبال سازمان و در راستای اجرای تصمیمات سازمان، از تحقق حقوق بنیادین بشر در سطحی برابر با کنوانسیون اروپایی حقوق بشر حمایت نکرده باشند، متحمل مسئولیت بینالمللی خواهند شد. بعبارت دیگر زمانی که یک دولت صلاحیت خود را به یک سازمان منتقل میکند ضروری است که اجرای سایر تعهدات بینالمللی خود را تضمین کند. در این مقاله سعی شده است باتوجه به کارکرد دکترین حمایت برابر در ساختار چند وجهی اتحادیه اروپا، نحوه نظارت دیوان اروپایی حقوق بشر بر عملکرد اتحادیه اروپا در حوزه حقوق بشر، مورد ارزیابی قرار گیرد.

The Doctrine of “Equivalent Protection”: Uncertainty on the Principle of Separation in the System of International Responsibility of Organizations

Abstract
|
The international organizations have independent legal personality which makes them responsible for their own wrongdoings. Therefore, member states of these organizations, are not responsible due to their mere membership. The European Court of Human Rights’ decision in the Bosphorus Case can be considered as a key case in the context of the Member States’ responsibility for the actions of international organizations. In this case, the European Court of Human Rights sought to determine when member states were responsible for actions carried out in the European Union. The doctrine of equivalent protection which first introduced in the caselaw of the European Court of Human Rights, and in particular in the Bosphorus case, undermines the independent personality and separate responsibility of the international organization and made an exception to it. Under this doctrine, EU member states will be internationally responsible if they do not protect fundamental human rights at a level equal to the European Convention on Human Rights. In other words, when a state transfers its competence to an organization, it is necessary to ensure that it fulfills its other international obligations. This article analyzes how the European Court of Human Rights monitors the European Union’s performance in the scope of human rights.
