آزادی بیان و اصل دوگانگی ایده و بیان

آزادی ‌بیان شامل آزادی در بیان، اندیشه، تحصیل و اشاعه آزادانه اطلاعات می‌باشد در مقابل کپی‌رایت با شناسایی حقوق انحصاری برای پدیدآورندگان، موجب محدودیت در دسترسی و اشاعه آثار مورد حمایت می‌شود. وقتی بیان مطرح شده دارای حق کپی‌رایت باشد آزادی سخنرانی و مطبوعات می‌تواند محدود شود. برخی معتقدند این دو نه تنها با یکدیگر تقابل ندارند بلکه ارزش‌های اجتماعی موجود در بطن نظام کپی‌رایت همان‌هایی است که مبانی آزادی ‌بیان را تشکیل می‌دهند. اهداف مشترک مانند گسترش جریان فرهنگی و ارتقای فرآیند خلاقانه در جامعه موجب کنش متقابل و هم‌افزایی این دو می‌گردد. اصل دوگانگی ایده و بیان با تعیین گستره مورد حمایت کپی‌رایت و تمیز آن‌چه که به حیطه عمومی تعلق دارد و حمایت نمی‌شود با آن‌چه که مورد حمایت است تعامل سازنده آزادی ‌بیان و کپی‌رایت را تضمین و از منافع عمومی جامعه و عدم محدودیت آزادی‌ بیان حمایت می‌کند. این مقاله می‌کوشد به این پرسش پاسخ دهد که چگونه می‌توان میان منافع عمومی جامعه در برخورداری از حق آزادی ‌بیان با منافع خصوصی صاحبان آثار در برخورداری از حق انحصاری بهره‌برداری، تعادل ایجاد کرد؟ اصل دوگانگی ایده و بیان به‌مثابه پارسنگ ترازو در ایجاد موازنه میان این دو حق دستاورد تحقیق است.

Freedom of Expression and Idea-Expression Dichotomy

Freedom of expression includes the freedom to express, access and dissemination of information, whereas copyright, by protecting the original works of authorship, restricts use, access and dissemination of the protected works. When an expression is protected by copyright, freedom of expression or press can be restricted. Some are of the opinion that these two rights are, in fact, not in conflict with each other but rather derived from the same social values seeking to protect each right. Common goals such as flow of cultural ideas or promoting creativity in the society causes interaction and synergy between the two. Ideaexpression dichotomy by determining the scope of the copyright and distinguishing what belongs to the public domain, which is not a protected, will ensure a constructive interaction between the two and protects the public interest and dose not restrict freedom of expression. This article will discuss how to strike a balance between the public interest in freedom of expression and the private interests of the copyright owners without undermining the other. Ideaexpression dichotomy as a counterbalance between these two rights is the cornerstone of this article.
