چکیده
|
شیوع کروناویروس در ایتالیا سبب فراهم شدن چارچوبی برای اعلام وضعیت اضطراری توسط دولت شده است. این مهم علی‌رغم ایجاد فرصت برای مدیریت مقتضی بحران، خطر محدودیت بیش از حد حقوق بنیادین مردم را به وجود آورده است. پرسش اصلی مقاله این است که اقدامات حکومت ایتالیا برای جلوگیری از کروناویروس تا چه حدی با حقوق بنیادین اعلام شده در قانون اساسی این کشور قابل تطبیق می‌باشند؟ که با روش توصیفی تحلیلی به واکاوی آن می‌پردازد. پس از بررسی مفهوم وضعیت اضطراری، توصیف تصمیمات ویژه حاکمیت و اعلام چالش‌های مربوط به محدودیت حقوق بنیادین، این نتیجه حاصل می‌شود که اقدامات دولت، تاثیرگذاری بسیار منفی بر تضمین حقوق بنیادین و آزادی‌های عمومی مردم داشته‌اند. نه تنها این تصمیمات اضطراری و فوق‌العاده، مخل حقوق مردم در یک نظام مردم‌سالار محسوب می‌شوند، بلکه عدم نظارت دقیق مجلس بر اعمال هیات وزیران سبب می‌شود تا نگاه‌ها و نظرات انتقادی به اعمال دولت این کشور منطقی به نظر برسند.

Abstract
|
The spread of Coronavirus in Italy has created the conditions for the government to declare the State of emergency. It has given the opportunity to manage the crisis, but has also limited people’s fundamental rights. In this research, through the deductivedescriptive method, we will try to answer this main question: the actions of the Italian government to counter Coronavirus until what point are compatible with the fundamental rights present in the Constitution? After describing the concept of State of emergency, the government’s decisions and the challenges about restriction of fundamental rights, we conclude that the government’s actions have had a very negative impact on fundamental rights and freedoms. Not only these emergency decisions have had a very negative impact on people’s rights in a democratic system, but the lack of parliamentary oversight about the actions of the Executive makes it reasonable to take a critical look at the actions of the Italian government.
