ضرورت همسویی مجلس شورای اسلامی با تعهدات بین المللی دولت در مقابله با جرایم مرتبط با مواد مخدر و روان گردان

جرایم مرتبط با  مواد مخدر و روان‌گردان، تهدیدی جدی برای حقوق بنیادین بشر و نیز بنیان‌های اقتصادی، اجتماعی و فرهنگی جوامع ملی و نظم و امنیت بین‌المللی محسوب می‌شوند. مقابله با جرایم مذکور، مسئولیت فردی و جمعی کلیه دولت‌هاست که باید توام با رعایت الزامات حقوق بشری صورت گیرد. یکی از مهمترین الزامات حقوق بشری در جهان معاصر، محدود کردن مجازات اعدام به «خطیرترین‌جرایم» است.با توجه به اینکه نهادهای بین‌المللی حقوق بشری، جرایم مرتبط با مواد را در زمرۀ خطیرترین‌جرایم نمی‌دانند؛ مجلس می‌تواند با محدود کردن مجازات اعدام، نقش موثری در اجتناب از پیدایش مسئولیت بین‌المللی برای دولت ایران ایفا کند.

The Necessity for the Parliament of Islamic Republic of Iran to Align Itself with International Obligations of State in Combating Crimes Related to Drugs and Psychotropic Substances

Crimes related to drugs and psychotropic substances are recognized as threats to human rights. They have also a devastating impact on the economic, social and cultural foundations of national societies, as well as, on international order and security. Serious measures have been taken to control and deal with those crimes, yet these actions should be consistent with human rights requirements. Limiting the death penalty to the most serious crime is one of the most important human rights requirements in the contemporary world. Since human rights institutions have not considered drugrelated crimes as one of the most serious crimes, the parliament can play an effective role in avoiding the emergence of international responsibility for the Iranian government by limiting the death penalty.
