تعهد متصدی حمل به اظهار اجمالی کالا در مقابل گمرک

در حمل و نقل بین‌المللی بار، کالا به واسطه عبور از مرزهای کشورها موضوع کنترل و تشریفات گمرکی قرار می گیرد. تکلیف اصلی انجام تشریفات گمرکی بر دوش خود صاحب بار قرار دارد. لیکن قوانین گمرکی در بیشتر کشورها، متصدیان حمل بین المللی را ملزم ساخته‌‌اند تا به محض ورود به قلمرو گمرکی، بدوا کالا را اظهار اجمالی نموده به طوری که تا پیش از آن تخلیه بار میسر نمی باشد. هدف از نگارش این مقاله روشن ساختن مبنا، شرایط و آثار «اظهار اجمالی کالا» از سوی متصدی حمل است که تاکنون در ادبیات حقوقی ایران به آن توجه نشده است. با بررسی شرایط و ضمانت اجرای قانونیِ اظهار اجمالی از سوی متصدی حمل، ابتنای این تعهد بر اسناد حمل مربوطه (بارنامه یا راهنامه) مشخص گردید و ثابت شد که توصیفات فرستنده بار در چنین اسنادی مبنا و تعیین کننده میزان مسئولیت متصدی حمل در مقابل مراجع گمرکی قرار می گیرد. نوآوری این مقاله در آن است که یک قاعده حقوق گمرکی را از زاویه حقوق حمل و نقل و با  اتکا به قواعد آن مورد تجزیه و تحلیل قرار داده است.

The Carrier’s Duty of Customs Summary Declaration

The goods shall be subject to customs formalities while crossing national borders in international transportation. The main duty to meet the above formalities lies against the cargo owner which, in deed, is assignable to an agent _ who might be the carrier. However, the carrier itself is obliged to submit a summary declaration of the total cargo before the customs authorities prior to the cargo unloading. The summary declaration is submitted based on the transport documents so that the governing rules could only be construed in line with the transportation law. The legal basis of summary declaration, the exemption from this duty, the carrier who shall declare, the legal nature of manifest and the remedy of non compliant declaration are some of the issues that are dealt with in this article. This article is distinct in this respect that it has analyzed a customs legal rule from the perspective of transport law.
