انسانی شدن حقوق محیط زیست در پرتو کرامت انسانی

حقوق بین الملل محیط زیست از جمله شاخه های حقوق بین الملل است که در چند دهه قبل به خصوص از دهه 1970 رشد و توسعه یافته است. چند دهه گذشته فرایند انسانی شدن حقوق بین الملل نیز آغاز و به شاخه های مختلف آن تسری یافت. انسانی شدن حقوق بین الملل ابتدا از رویکردی فرد محور متعاقبا رویکردی بشریت محور به خود گرفت. بدین معنا که بدنبال تحقق هدف های عالی مشترک در میان کل بشریت می باشد. حقوق بین الملل محیط زیست از جمله شاخه‌های حقوق بین الملل است که تحت تاثیر این فرایند قرار گرفته و با توجه به عوامل عینی و ذهنیِ موجود در فضای زیست محیطی، دارای رویکردی بشریت محور می باشد. به نظر نگارنده آنچه منجر به انسانی شدن حقوق محیط زیست و رویکرد بشریت محور در آن شده است نفوذ مولفه‌های کرامتی با استناد به کرامت انسانی در حوزه حقوق محیط زیست و ظرفیت‌هایی است که مفهوم کرامت انسانی از آن برخوردار است.

Humanization of environmental law in the light of human dignity

International Environmental Law is one of the branches of international law that has been developed several decades ago, especially after 1970. Since then, the process of humanization of international law has begun and extended to various branches of international law. The humanization of international law had begun with an individualoriented approach, and changed to humankindapproach afterwards, which means it seeks to achieve common high goals among all humanity as a whole. International environmental law is one of the branches of international law that is influenced by this process and based on objective and subjective factors in the environmental field has a humankindapproach. To the authors, the influence of the dignity elements on the basis of invoking to human dignity in the field of environmental law and human dignity capacities, has led to humanist and the humankindapproach of environmental law.
