بایسته های حقوقی بودجۀ نهادگرا

پژوهش پیرامون بودجه در ایران پیشین های طولانی دارد. در این تحقیق، مولفه های رویکرد برون سیستمی نظام حقوقی بودجه با عنایت به تحلیل نهادگرا تبیین و موانع اصلاح آن در ایران بررسی شده است. دستاورد این تحقیق، صرف نظر از طرح رویکرد جدیدی در رشتۀ حقوق مالیه عمومی، بیان ضرورتها، مبانی و راهکارهای اصلاح نظام حقوقی حاکم بر بودجه در ایران است . مهمترین دستاورد این تحقیق آن است که نظام حقوقی بودجه در ایران، بیشتر در پرتو نهادهای غیررسمی شکلگرفته و اگرچه بعد از انقلاب مشروطه، مجموعه قوانین و مقرراتی در این زمینه وضع شد، اما رویه های مربوط به حکمرانی، سازمان دولت و نهادهای مرتبط باآنکه موجب بسط نظام غارتی، تهدید مالکیت خصوصی، کمتوجهی به لوازم توسعه و شاخصههای حکمرانی خوب در ایران بوده است، بدون اصلاح نهاد دولت و ایجاد تحول در تصمیم گیری ها و تخصیص منابع، وضعیت نامطلوب گذشته را استمرار خواهد داد. بر این اساس بازنگری نظام حقوقی بودجه در گرو اصلاح حقوق اساسی و نظام اداری است.

Legal Necessities of Institutional Budget

Research about the budget in Iran has a long history. In this research, we will explain components of the outsidesystematic approach to the legal budget system and the obstacles to its reform in Iran with regard to the institutional analysis. This research achievement, regardless of the introduction of a new approach in the field of public finance law, is the expression of neccessities, principles and strategies for reformation of budget legal system in Iran. The most important result of this Study is that the budget legal system in Iran is shaped In the light of informal institutions; and although after the Constitutional Revolution a series of laws and regulations were enacted in this field, but procedures related to governance, the structure of the government and related organizations have contributed to extending the looting system, threatening the private property, lack of enough attention to the development means and good governance in Iran. Therefore, without reforming the government institution and change in the state’s decision making process and allocating the resources, the previous unfavorable situation will continue.
