مرورزمان دعاوی قربانیان کاربرد سلاح های شیمیایی جنگ عراق با ایران

مرورزمان مانعی در راه اقامه دعاوی اعم از کیفری و حقوقی است. بسته به این‌که مرورزمان در چه نوع دعاوی مطرح شود، ماهیت و اهداف و آثار و قواعد حاکم بر آن متفاوت خواهد بود. در رابطه با استفاده از سلاح‌های شیمیایی و نقض قواعد حاکم بر ممنوعیت استفاده از آن‌ها، مساله مرور زمان در هردو دسته دعاوی حقوقی و کیفری قابل طرح است. با توجه به گذشت مدت زمان مدیدی از اتمام جنگ ایران و عراق، امکان استناد به مرورزمان در دعاوی مربوط به استفاده از سلاح‌های شیمیایی طی این جنگ در دادگاه‌های ملی و بین‌المللی وجود دارد. باتوجه به این‌که مرور زمان یک اصل کلی حقوق است که از نظام‌های داخلی وارد حقوق بین‌الملل شده است، این مقاله ضمن تبیین اصل مرورزمان در نظام‌های حقوقی داخلی و بین‌المللی، به این نتیجه می‌رسد که باتوجه به عدم احقاق حقوق قربانیان سلاح‌های شیمیایی جنگ عراق با ایران، هرچند هنوز امکان اقامه دعوای کیفری برای قربانیان وجود دارد، اما اقامه دعاوی حقوقی و مطالبه خسارت می‌تواند با مانع مرورزمان برخورد کند.

The Statute of Limitations of Actions of Victims of the Use of Chemical Weapons during IranIraq War

Statute of limitations is an obstacle to sue and prosecute crimes. According to the nature of the actions, nature, purpose, effects and rules governing statute of limitations will be different. In relation to the breach of the rules governing the prohibition of the use of chemical weapons at the time of international conflict, both types of statute of limitations emerge. Considering the passage of time from the end of the IranIraq war, the statute of limitation in cases involving the use of chemicals weapons during the war would be a defense in national and international courts. In this article, through explaining the statute of limitations in national and international legal systems, I conclude that although it is possible to prosecute and punish perpetrators of the use of chemical weapons during IraqIran war before the national courts, statutes of limitations have posed a major obstacle to reparation claims.
