حدود تعهدات و آثار بیلمنت در مقایسه با نهاد ید امانی

بیلمنت (bailment) یکی از اسباب ایجاد تعهد در نظام کامن‌لا است که مورد پذیرش رویۀ قضایی واقع شده است. حدود تعهدات و آثار این نهاد مورد اختلاف حقوق‌دانان کامن‌لایی است، اما در برخی جنبه‌های آن وفاق وجود دارد. اگر این نهاد را با نهادهای حقوق ایران مقایسه کنیم، شاید شبیه‌ترین نهاد به آن، نهاد ید امانی باشد؛ هرچند به‌واقع معادل دقیقی برای آن وجود ندارد، به‌خصوص که انتقادات وارد بر نهاد بیلمنت در حقوق کامن‌لا و عدم پذیرش آن از سوی همۀ حقوق‌دانان، بر ابهامات آن افزوده است و برخی از آنها قائل به دایرۀ محدود مصادیق این نهاد هستند. در مطالعۀ تطبیقیِ آثار و تعهدات ناشی از بیلمنت، ضروری است مصادیق این نهاد با حقوق ایران مقایسه شود. زیرا این نهاد دارای معادل مشخصی در حقوق ایران نیست و با نهاد گستردۀ ید امانی مطابقت نسبی دارد، اما مصادیق این دو نهاد واحد نیستند، لذا لازم است علاوه بر تطبیق کلی دو نهاد، تطبیق جزئی در مصادیق نیز انجام شود.
