همه‌گیری کرونا و تاثیر آن بر رسیدگی کیفری (مطالعۀ تطبیقی فرانسه، بلژیک و ایران)

گرچه تنها بیش از یک سال از اعلام همه‌گیری ویروس کرونا می‌گذرد، ولی در این مدت کوتاه این ویروس زندگی بشر را در ابعاد مختلف تحت تاثیر قرار داده است. رسیدگی کیفری نیز از این همه‌گیری تاثیر پذیرفته است. مجازی شدن فرایند دادرسی کیفری به‌منظور کاهش مراجعۀ مردم به دادگستری، تغییر در ساختار دادگاه‌ها، تغییر در مواعد دادرسی و تعلیق مرور زمان ازجمله مواردی است که در اثر همه‌گیری کرونا دستخوش تحول شده است. این مقاله در صدد است با رویکردی تطبیقی تغییرات صورت‌گرفته در اثر همه‌گیری کرونا در رسیدگی‌های کیفری را در نظام کیفری فرانسه، بلژیک و ایران بررسی کند. مطالعۀ نظام حقوقی در این سه کشور نشان می‌دهد که گسترش دادرسی الکترونیکی وجه مشترک سه نظام بوده است. تغییر در مواعد دادرسی و تعلیق مرور زمان وجه مشترک نظام فرانسه و بلژیک بوده است و تغییر در ساختار دادگاه‌ها صرفاً در نظام فرانسه مشاهده می‌شود.

Covid-19 Pandemic and its Impact on Criminal Proceeding(Comparative Study in France, Belgium and Iran)

More than a year has passed since the Coronavirus pandemic, but in this short period of time, this virus has affected various dimensions of human life. Criminal proceeding has not been immune to the deleterious effects of this pandemic. Virtualizing the criminal justice process in order to reduce referral to the courts, changing in the structure of the courts, modifying the terms of trial and suspending the prescription are some of changes introduced in the wake of Coronavirus pandemic. This article aims to examine criminal proceeding adjustments in the penal systems of France, Belgium and Iran from a comparative approach. The analysis of the legal systems of France, Belgium and Iran suggests that the expansion of the electronic process is a common feature shared by all three systems. Changes in trial terms and suspension of prescription were shared by the French and Belgian systems, whereas alterations in the structure of courts was exclusive to the French system.
