حمایت دیپلماتیک از تبعه در مقابل دیگر دولت متبوع او در حقوق بین‌الملل در پرتو اعلام حمایت دیپلماتیک بریتانیا از خانم نازنین زاغری

حمایت دیپلماتیک دولت از تبعۀ خود در مقابل دیگر دولت متبوع او از مسائل چالش‌برانگیز حقوق بین‌الملل است که اخیراً با اعلام حمایت دیپلماتیک دولت بریتانیا از خانم نازنین زاغری که یک فرد دوتابعیتی ایرانی-بریتانیایی است بسیار برجسته شده است. با اینکه در حقوق بین‌المللِ سنتی اغلب در چنین وضعیت‌هایی عدم مسئولیت دولت متبوع مورد توجه قرار می‌گرفت، امروزه حمایت دیپلماتیک از سوی دولتی که فرد چندتابعیتی، تابعیت غالب و موثر او را دارد، علیه دیگر دولت متبوع او امکان‌پذیر است. فارغ از تابعیت غالب خانم زاغری، رفتار دولت بریتانیا که در اقدامات ملی و بین‌المللی آن نمود پیدا کرده، نشان‌دهندۀ این است که این دولت اعتقادی به حمایت دیپلماتیک از تبعۀ خود در مقابل دیگر دولت متبوع او ندارد، جز در مواردی که دیگر دولت متبوع فرد، او را بریتانیایی قلمداد کند؛ بنابراین، بریتانیا ممکن است ماخوذ به شیوۀ عمل خود شود. بریتانیا می‌تواند با توسل به پروتکل اختیاری منضم به کنوانسیون روابط کنسولی (1963م) و ادعای نقض مادۀ 36(1) کنوانسیون از سوی ایران به دیوان بین‌المللی دادگستری مراجعه کند. با ‌این حال، آزادی خانم زاغری که بریتانیا به‌دنبال آن است نتیجۀ مستقیم مراجعه به دیوان نخواهد بود.

Diplomatic Protection for the National against another State of Nationality in International Law in the light of the Announcement of UK for Diplomatic Protection for Ms. Nazanin Zaghari

The State’s diplomatic protection for its national against another State of nationality is the most challenging issue in international law which most recently highlighted by the announcement of the UK for diplomatic protection for Ms. Nazanin Zaghari who is an IranianBritish dual national. Although the nonresponsibility of the State of nationality has been frequently taken into account in such situations in traditional international law, it is now possible to have diplomatic protection against another State of nationality by a State that a multiple nationality has its dominant and effective nationality. Regardless of Ms. Zaghari’s dominant nationality, UK’s practice in its national and international activities shows that it does not believe to do diplomatic protection against another State of nationality, except in cases where the latter consider him British. Therefore, the UK may be affected by its practice. The UK may resort to the International Court of Justice by reference to the optional protocol attached to the Vienna Convention on Consular Relations (1963) and alleging the violation of Article 36(1) of the Convention by Iran. However, Ms. Zaghari’s release, which the UK is seeking, will not be a direct result of this resort.
