مفهوم بشریت در آیینۀ مکاتب حقوق بین الملل؛ جدال رویکرد مدیریت گرا در برابر طرح انسانی شدن

در ادبیات حقوقی معاصر اختلاف نظر بسیاری پیرامون مفهوم بشریت وجود دارد. هریک از مکاتب و رویکردهای حقوقی با توجه به مبنای مورد قبول خود، نسخه‌ای متفاوت با مفهوم بشریت و جایگاه آن در حقوق بین‌الملل را به‌تصویر می‌کشند. مکاتب حقوق طبیعی و پوزیتیویستی و نرماتیویستی برداشت موردنظر خود را بر این مفهوم حقوقی تحمیل می‌کنند. از سوی دیگر، نگرش انتقادی به حقوق بین‌الملل نارسایی‌های این اندیشه‌ها را بیان می‌کند. نکتۀ قابل تامل در این خصوص، تاثیر جدال‌های نظری موجود در خصوص ظرفیت این مفهوم در تغییر روند تحولات حقوق بین‌الملل است؛ وگرنه در چارچوب تحلیل‌های فنی در خصوص صورت حقوقی بالفعل این مفهوم، مناقشۀ چندانی وجود ندارد. در این پژوهش با روش تحلیلی توصیفی، بشریت بر اساس معیارها و ضوابط حاکم بر چارچوب‌های فکری مکاتب عمدۀ حقوق بین‌الملل مورد سنجش قرار خواهد گرفت تا تصاویر مختلفی که از مفهوم بشریت در قالب تئوری‌های حقوقی ترسیم شده است، تحلیل شود.

Reflection of the concept of Humanity in international law: controversy between managerialism and humanization

The concept of Humanity is one of the most controversial concepts in the contemporary international law legal literature. Every legal school of thoughts and legal approaches present a different version of the concept and its statues in international law, according to their preapproved premises. Natural law school along with positivists and normativist are imposing their own stablished readings on this concept, but on the other hand, critical theorist of international law (CIL) have exposed their theoretical deficiencies and flaws. The core of this discourse has been focused on the potentials of the concept of humanity on diverging the trends of evolution in international law, although in a positivistic view, there is not that much controversy. This study will evaluate the concept of humanity based on the diverse criteria of aforementioned schools of thoughts, in order to depict and analyze the diversity of different version of the concept of Humanity in legal theories.
